"Against God's Will": Gay Man Sues NJ Hospital For Being Denied HIV Meds

New Jersey gay man Joao Simoes is suing his hospital after an on-staff doctor refused him his HIV medications. Dr. Susan Borga* allegedly later told his private physician what the patient had done to become infected was "against God's will."
When the hospital finally permitted Simoes to call his personal physician on the third day of his stay, he learned that the doctor had already spoken with Borga about Simoes' medication, according to the complaint. Borga allegedly responded: "You must be gay, too, if you're his doctor." "Additionally, apparently realizing that plaintiff's doctor had an accent, Dr. Borga exclaimed, 'What, do you need a translator?' to which plaintiff's doctor had again responded that Dr. Borga needed to give plaintiff his HIV medication," the complaint states. "Dr. Borga responded to plaintiff's doctor by stating, 'This is what he gets for going against God's will,' and hung up the phone on plaintiff's doctor."
The hospital also initially refused to allow the patient's sister to visit him. She was finally permitted to bring him his medications after he'd missed five doses. Missing doses of HIV medication can cause the patient to become resistant to the drugs.

Incidentally, my earlier headline that "Bloomberg wants your Big Gulp" turns out to be technically untrue. 7-Eleven does not make food on the premises and is therefore not subject to the coming law, which only applies to businesses inspected by the NYC Health Department.

GALLUP POLL: 46% Of Americans Are Young Earth Creationists

Gallup poll:
Forty-six percent of Americans believe in the creationist view that God created humans in their present form at one time within the last 10,000 years. The prevalence of this creationist view of the origin of humans is essentially unchanged from 30 years ago, when Gallup first asked the question. About a third of Americans believe that humans evolved, but with God's guidance; 15% say humans evolved, but that God had no part in the process.
We are truly doomed.

ILLINOIS: State Attorney General To Back Same-Sex Marriage Challenge

Illinois Attorney General Lisa Madigan has announced that her office will present arguments in support of the challenge to the ban on same-sex marriage. Nice!
The lawsuits, filed Wednesday, are against the clerk of Cook County and claim that his refusal to issue marriage licenses to same-sex couples violates those couples’ rights to due process and equal protection under the Illinois Constitution. Today's filing said that the attorney general will "present the Court with arguments that explain why the challenged statutory provisions do not satisfy the guarantee of equality under the Illinois Constitution." Cook County Clerk David Orr has stated that he applauds the lawsuits and is in favor of same-sex marriage. Officials from the state’s attorney’s office, which will represent Orr, did not respond to calls seeking comment. Gov. Pat Quinn has also expressed his support for same-sex marriage.

Queen Latifah: I Didn't Come Out

Queen Latifah says that despite the way some in the audience received her words, she definitely did not come out during her performance at Long Beach Pride.
“That definitely wasn’t the case,” she tells EW. “I’ve never dealt with the question of my personal life in public. It’s just not gonna happen.” That said, the 42-year old was thrilled to participate in the event and even recalled an earlier performance for gay audiences. “To me, doing a gay pride show is one of the most fun things,” she says. “My first show that paid more than $10,000 was in a gay club on New Year’s Eve in San Francisco. Tupac happened to be in town, so he came to kick it with me. This was the early ’90s. And the boys were like, ‘Take your shirt off, Tupac!’ He wasn’t doing that. But we had a blast in there.”

CDC: There Are No Actual Zombies

You may recall that last year the Centers for Disease Control released its well-received Zombie Apocalypse Report, which was actually their cheeky way of encouraging disaster preparedness. However several recent news items forced the CDC to announce today that there are no actual zombies.
"CDC does not know of a virus or condition that would reanimate the dead (or one that would present zombie-like symptoms)," wrote agency spokesman David Daigle in an email to The Huffington Post. Nevertheless, recent incidents in which humans reportedly ate human flesh have the Internet in a firestorm, with "zombie apocalypse" being Google's third most popular search term by Friday morning.
Which takes me back to the warning I found scrawled on the men's room wall of a Hell's Kitchen gay bar back in 2005.
In the event of a zombie crisis:

1. Find a good man who's got your back.
2. Always aim for the brain pan.
3. Save a bullet for yourself, dude.

Conservative Jews OK Gay Weddings

I love when this sort of item arrives via Fox News:
The Conservative branch of American Judaism has formally approved gay marriage ceremonies. The Committee on Jewish Law and Standards decided the issue in a 13-0 vote Thursday with one abstention. The panel of legal scholars developed two styles of ceremony that can be used as a guide for a rabbi marrying a same-sex couple. The committee also issued a guide to gay divorce. Conservative Jews first signaled official acceptance of same-sex relationships in 2006 by lifting the ban on ordaining gays and lesbians.

Making Excuses For Dolan

The National Catholic Register twists itself into knots in a bizarre defense of the Dolan pedophile payoff scandal.

Consider this: Suppose you are walking down the street and a homeless person approaches you and asks you for some money. You give him the money. Would that justify a headline saying that you have been paying the homeless? Or suppose you were with your teenage son or daughter and they asked if they could give some money to the homeless person as an act of kindness and you said Yes. Would that justify a headling saying that you authorized paying the homeless? Or maybe you send your grandchild $20 for his birthday, because he's at that age where he's hard to buy for and what he really wants is money. Have you paid your grandson? Not all disbursements of money constitute "paying." Gifts, grants, charitable donations, and other forms of transferring money from one person to another do not automatically count as "paying."

Were the situation not so grotesque, the above would be laughable.

"It now looks like it will be this case, rather than the more famous Perry case being litigated by Ted Olson and David Boies, that will reach the Supreme Court first. It’s a bit of inside baseball, but this is the result favored by the old guard of gay-rights litigators who prefer a more incremental strategy of Supreme Court review. DOJ To Florida: Stop Voter Purge NOW

The Department of Justice has ordered Florida Gov. Rick Scott to immediately cease his campaign to purge legal citizens from the list of eligible voters.
DOJ also said that Florida’s voter roll purge violated the National Voter Registration Act, which stipulates that voter roll maintenance should have ceased 90 days before an election, which given Florida’s August 14 primary, meant May 16. Five of Florida’s counties are subject to the Voting Rights Act, but the state never sought permission from either the Justice Department or a federal court to implement its voter roll maintenance program. Florida officials said they were trying to remove non-citizens from the voting rolls, but a flawed process led to several U.S. citizens being asked to prove their citizenship status or be kicked off the rolls.
The DOJ's letter to Florida's secretary of state warns of "further action" should the campaign not end at once.

ILLINOIS: Erie School District Bans Kids Book Than Mentions Gay Families

The Erie School District has banned Todd Parr's well-regarded The Family Book because it mentions that some families have two moms or two dads.
"The parents concerns that were voiced were the source of the material. it was from G.L.S.E.N. (gay, lesbian and straight network). And also the book that won't be used moving forward was a family book and in that book it discussed different types of family structures," said Bradley Cox, Superintendent, Erie School District 1. Flipping through the book it talks about: Some families are the same color. Some families have a stepmom or stepdad. All families like to hug! So what's the big deal? Superintendant Bradley Cox said parents didn't like the non–traditional family structures, like having 2 moms or 2 dads. "Parents voiced a concern that those are issues that shouldn't be taught at the elementary school level, not that those aren't discussed at other grade levels," said Cox.

Tyler's Parents Reject Ravi's Apology

Calling it nothing more than a PR stunt, the parents of Tyler Clementi have refused to accept the apology offered Wednesday by Dharun Ravi.
In their first public comments on the sentencing, the Clementis issued a statement in which they rejected Mr. Ravi’s apology as insincere. “As to the so-called ‘apology,’ it was, of course, no apology at all, but a public relations piece produced by Mr. Ravi’s advisers only after Judge Berman scolded Mr. Ravi in open court for his failure to have expressed a word of remorse or apology,” they said in a statement. “A sincere apology is personal. Many people convicted of crimes address the victims and their families in court. Mr. Ravi was given that opportunity but chose to say nothing. His press release did not mention Tyler or our family, and it included no words of sincere remorse, compassion or responsibility for the pain he caused.”

GOP Wins Contested NY Senate Seat

After months of legal wrangling, recounts, and disqualified voters, Brooklyn GOP candidate David Storobin has been declared the winner of his New York Senate seat by 14 votes. His candidacy was funded by NOM, but they may not crow too much because the lengthy delay means Storobin will only have three weeks in office before his seat vanishes due to redistricting. You may recall that NOM paid the local anti-gay Orthodox Jewish group to publish ads stating that it was a violation of the Torah to vote for a supporter of same-sex marriage.

An Olympic Hopeful With Two Dads

A 13 year-old Olympic diving hopeful will be the grand marshal of Indianapolis Pride with his two dads.
Jordan Pisey Windle is used to being the center of attention. He has been the focus of his father's life since the day in 2000 when Jerry Windle retrieved him from a Cambodian orphanage. He has been turning heads for the past five years as a diving phenom, the youngest ever to qualify for the U.S. Olympic diving trials. And all eyes will be on him June 9 when he serves as grand marshal for the Circle City IN Pride Parade, an annual celebration of Central Indiana's lesbian, gay, bisexual and transgender (LGBT) community. The young athlete's decision to accept the parade invitation -- and the fact that he has two fathers -- is sure to raise eyebrows. But what other people think isn't of concern to the 13-year-old. He views the world so unself-consciously that when asked if he ever gets tired of people questioning him about his origins and his family, he simply shrugged. "I've never actually thought about it."

Feds Shut Down 26 Chinatown Bus Lines

The "Chinese bus" has long been the cheapest and to many, the hippest way to travel between the major cities of the Northeast. But long plagued by shoddy maintenance and not a few accidents, their safety record has been as legendary as the low price. Today the feds, for now, put an end to most of them.
Federal transportation officials citing serious safety concerns announced on Thursday that they had ordered the shutdown of 26 bus operators, many of them based in Chinatown and offering inexpensive rides along the East Coast to thousands of passengers a day. In addition, 10 bus company owners, managers and employees were forced to cease all passenger transportation operations, including selling tickets, according to transportation officials who called it the biggest crackdown in the history of the Federal Motor Carrier Safety Administration. The operators cited had employed drivers who worked long hours, had serious driver qualification violations and, in many cases, did not have valid commercial driver's licenses, officials said. The companies also used vehicles that had not been regularly repaired or inspected.
Today's move was apparently spurred by the gruesome 2011 accident in the Bronx in which 15 passengers were killed when the driver allegedly fell asleep behind the wheel. My own experience with the Chinese bus involves a Christmas Eve 2005 trip to DC in which it felt like we took every curve on two wheels. I almost kissed the ground when we got there.

2011: Most Anti-LGBT Murders Ever

The National Coalition of Anti-Violence Projects today issued a report containing the grim news that last year more LGBT people were murdered in hate crimes than in any year since the group began keeping records.
The 2011 report also highlights a number of disturbing trends concerning the severity of violence experienced by LGBTQH people. This year’s report shows that LGBTQH youth and young adults between the ages of 18 and 30 years old were 2.41 times as likely to experience physical violence compared to LGBTQH people age 30 and older. As in the case of the murder statistics, transgender people and people of color were more likely to experience physical injury in a hate violence incident. The report found that transgender people were 28% as likely to experience physical violence compared to non-transgender people, and that LGBTQ people of color were two times as likely to experience physical violence compared to those who were not LGBTQ people of color.
The report glumly notes that the sheer number of anti-LGBT violent crimes so taxed the organizations that track them, they could not fully investigate all of the incidents reported to them. Therefore, the actual number is higher.

Gotham's tabloids reacted with horror this week at the SHOCKING news that Gov. Cuomo has launched a makeover of the state's iconic "I ♥ NY" campaign, which is considered to be the most successful tourism slogan in the history of everything.
Thanks for breaking New York’s heart, Gov. Cuomo. The governor ripped the out of “I NY” in a new $5 million tourism campaign unveiled Wednesday. He’s dumping the state’s iconic logo, known the world over, in favor of such ho-hum images as a slice of pizza, a hot air balloon, a beach ball and a stock car — a nod, apparently, to the Empire State’s NASCAR roots. “You still have the icon but you have to bring it back to New York,” Cuomo explained. “You have to reimagine, you have to reenergize it.”

One Million Shrews Against Father's Day

It is obvious that JCP would rather take sides than remain neutral in the culture war. JCP will hear from the other side so they need to hear from us as well. Our persistence will pay off! One day we will answer for our actions or lack of them. We must remain diligent and stand up for Biblical values and truth. Scripture says multiple times that homosexuality is wrong, and God will not tolerate this sinful nature.

OMM will continue to avoid shopping at JCP until they take a neutral stand. If you receive their advertising booklets or catalogs in the mail, OMM recommends you write "REFUSED...RETURN TO SENDER" on your JCPenney catalog and try sending them back. If they receive an onslaught of their returned magazines, they will take notice.

NY Court Rules "Gay" Is Not Slander

A New York state appeals court ruled today that falsely calling somebody "gay" can longer be considered slander.
The court says that although falsely calling someone gay or lesbian has for decades been grounds for slander, that's no longer the case because being gay is no longer seen by society as negative. The decision Thursday involves the case of a Broome County man who sued after he was called gay, saying that hurt his relationship with his girlfriend. The court says a "tremendous evolution of social attitudes" and rights afforded to gays prompted the decision that overrules previous rulings.
RELATED: Last year when I first covered the initial ruling in favor of the plaintiff, I noted that while other jurisdictions had already ruled that calling somebody "gay" is not slanderous, the New York appeals court had never been asked to make such a ruling. Now they have and it isn't.

FOTF Outraged Over DOMA Ruling

"Today’s decision from the First Circuit overruling a portion of the Defense of Marriage Act (DOMA) was an unfortunate exercise of judicial tampering with the rules by which constitutional cases are decided. The Court began by recognizing that this case would fail under the usual tests that courts apply to these cases, and then proceeded to invent a new test by which the federal DOMA failed. Unfortunately, we’ve come to expect strange decisions like this from judges bent on redefining marriage for all of us.

Doing Good Without God

UC Berkeley has published a series of "generosity" experiments intended to test the "pro-social behaviors" of both atheists and the religious. Unsurprisingly (to the readers of this blog, at least), atheists scored highly in the experiments.
“The main take-away from the research is that there may be very different reasons why more and less religious people behave generously, when they do,” said Robb Willer, an assistant professor of sociology at Berkeley and a co-author of the studies. “Across three studies, we found compassion played a much bigger role in the way that less religious people treated others. Religious people, in contrast, tended to behave as generously as they would regardless of how compassionately they felt.” At the same time, Willer said, the view of nonreligious people as cold and amoral needs adjustment. “We find that nonreligious people do feel compassion for others, and that those feelings are strongly related to whether they choose to help others or not.”
An evangelical professor interviewed for the above-linked article noted that religious people don't need to feel compassion to perform good deeds, they do it because they believe God expects them to.

Gay Couple Shown In U.S. Tourism Ad

They're only on screen for less than a second, but predictably Tony Perkins is furious that a gay couple is shown in a new international ad promoting U.S. tourism. Via Right Wing Watch:
In 236 years, America's never had an international tourism ad. So when Congress passed the Travel Promotion Act, people thought it'd be a great chance to highlight American attractions. What they didn't know is that it would highlight same-sex attractions. That's right. The commercial invites people to America-not to see the Grand Canyon, but to celebrate homosexuality. In one scene, a gay man is sleeping on his partner's shoulder in a trolley. The actors said they were specifically recruited to add a "homosexual presence" to the commercial. According to Brand USA, the ads were supposed to "open up some minds as to what America really is"-which, based on this commercial, is a country of radical values and backwards priorities. I suppose this is part of the President's push to "rebrand" America. It's just too bad he used a travel ad to feature so much cultural baggage.

INDIANA: Sheriff Denies Claim That "Ain't No Homos" Church Got Death Threats

It turns out that Pastor "Ain't No Homos In Heave" Sangl lied to the media when he claimed that his church has gotten death threats. Shocking! The best part is that the truth comes via Fox News:
“To my knowledge, there are no death threats at this time,” Decatur County Sheriff Gregory Allen told FoxNews.com. He was responding to a report on TMZ.com that Jeff Sangl, pastor of Apostolic Truth Tabernacle Church in Greensburg, Ind., had received death threats after the video hit the Internet Wednesday. Allen told FoxNews.com that Sangl, who has left town and could not be reached for comment, contacted the department and asked him to keep an eye on the church's property following the surfacing of the video.

BREAKING: Federal Appeals Court Overturns Key Provision Of DOMA

Big news! The First Court of Appeals ruled in Boston today that it is unconstitutional to deny federal marriage benefits to same-sex couples. The ruling applies to Section Three of the Defense Of Marriage Act.
The appeals court agreed with a lower court judge who ruled in 2010 that the law is unconstitutional because it interferes with the right of a state to define marriage and denies married gay couples federal benefits given to heterosexual married couples, including the ability to file joint tax returns. The court didn't rule on the law's other provision, which said states without same-sex marriage cannot be forced to recognize gay unions performed in other states.
Metro Weekly provides a portion of the ruling:
[M]any Americans believe that marriage is the union of a man and a woman, and most Americans live in states where that is the law today. One virtue of federalism is that it permits this diversity of governance based on local choice, but this applies as well to the states that have chosen to legalize same-sex marriage. Under current Supreme Court authority, Congress' denial of federal benefits to same-sex couples lawfully married in Massachusetts has not been adequately supported by any permissible federal interest.
