Photo Of The Day - Pride Flag Raising

Just after my bit on SiriusXM was finished, I hustled across the street where Providence Mayor Angel Tavares hosted Rhode Island Pride for the ceremonial raising of the rainbow flag over City Hall. Tavares is a member of Freedom To Marry's coalition of over 70 marriage-supporting city mayors and he spoke passionately about LGBT rights before leading the enthusiastic crowd in a countdown to the flag raising. Providence may be a state capital, but the entire event had a sweet small town feel to it.

FRC Launches Campaign Against Target

The Family Research Council today launched a campaign against Target. Because donating money to a gay parenting group is going to rip babies out of the arms of righteous white Christian women. Or something.
The Family Equality Council's clear objective is to pass legislation on the local and national level that would effectively shut down Christian based adoption agencies. We have seen this happen in Illinois, Massachusetts and Washington, D.C. The legislation orders all adoption agencies to no longer put a priority in placing a child in a home with a mom and dad, despite the overwhelming evidence that such households are by far the best environment for a child. By making itself a clearinghouse for donations to a pro-homosexual group, Target has sent the message that they are 100 percent behind efforts to deny you the right to vote on marriage at the ballot box, and to shutter adoption agencies that prioritize placing children with mothers and fathers.

Loesch just tweeted the above photo in front of the Daily Kos logo. (Netroots began as a Daily Kos event.) Hoft, you may recall, is the lying freak who claimed that the Obama campaign was using Jumbotrons to order his audiences to applaud, when in fact he was citing the closed captioning for the deaf which was noting that the audience had applauded.

Wingnuts Attack Senate Candidate Elizabeth Warren For Attending Netroots

Here's how teabagger site Daily Caller sees it:
Massachusetts Democratic Gov. Deval Patrick and Republican Sen. Scott Brown attended the Friday funeral of a slain Massachusetts police officer, Kevin Ambrose, who died Monday while on duty. There is, of course, a noticeable absence from the list of mourners. Democratic Senate candidate Elizabeth Warren apparently couldn’t be bothered. She’s hanging out at the blogger convention Netroots Nation, which features such events as “Beyond Occupy: What Does a New Economic System Look Like?”
Warren has never held elected office and therefore would have no official purpose in attending that funeral. But the teabaggers are so afraid of her unseating Sen. Scott Brown, they'll reach for any nutso reason to attack her.

NEW YORK: Appeals Court Rules That HIV+ Saliva Is Not A "Deadly Weapon"

A panel of judges on the New York Court of Appeals has unanimously overturned a lower court and ruled that if an HIV+ person spits on or bites somebody, his saliva cannot be considered a "deadly weapon or dangerous instrument."
David Plunkett was serving a 10-year sentence for punching and biting a police officer. The incident occurred in 2006 when Plunkett was causing a disturbance as a patient at an Ilion clinic. Plunkett reportedly had a history of medical illness and assaulted one of the responding officers. In New York, in order for assault to become aggravated assault (which carries a greater penalty), the use of a deadly weapon or dangerous instrument is required. The original judge considered HIV-positive saliva a deadly weapon, making biting an aggravated assault. Plunkett pleaded guilty to both assault and aggravated assault. However, on June 7, the court dismissed the aggravated assault conviction, stating saliva should be treated the same as teeth, which in 1999 were deemed not to be dangerous instruments on the grounds that body parts come with the person and thus do not increase criminal liability.

Pelosi Vows To Drop DOMA Defense

That is, IF the Democrats win back the House.
“First of all, we can expect something to go away, like stop spending taxpayer dollars on the Defense of Marriage of Act, which is a waste of money and not the right thing to do,” Pelosi said. Pelosi had previously criticized House Speaker John Boehner (R-Ohio) for taking on defense of DOMA after the Obama administration announced it would no longer defend the anti-gay law and has called on House Republicans to discontinue that effort, but never before pledged to drop defense of DOMA if Democrats resumed control of the House.

She said she thinks Republicans believe DOMA is unconstitutional because when they controlled the House under the Bush administration, they tried to pass court-stripping provisions denying judicial review for the anti-gay law and others. “They had to know that there was a weakness constitutionally in that bill, if they would want to put court-stripping provisions in relating to DOMA and the rest,” Pelosi said. “So, we think they know it’s weak constitutionally.”

CDC Reports Decline In HIV Education

Via press release:
Today, the U.S. Centers for Disease Control and Prevention (CDC) released its 2011 National Youth Risk Behavior Survey (YRBS), which tracks everything from seat belt utilization to tobacco use among America’s youth. While the report showed improvements among many risk factors, the percentage of U.S. high school students who had learned about HIV/AIDS in school dropped from 91.5 percent in 1997 to 84 percent in 2011. At the same time, only 60 percent of young people reported using a condom during their last sexual encounter. “With young people, especially young gay men, facing such a heavy burden of HIV, today’s data further instructs the nation to do more to educate youth about sexual health,” said National Minority AIDS Council Director of Legislative and Public Affairs Kali Lindsey.

Philly Mayor Backs Big Gulp Ban

Philadelphia Mayor Michael Nutter is backing Bloomberg's proposed ban on large servings of sugary drinks.
“Sugary drinks, like soda, fruit drinks and sweetened teas, are the single largest sources of sugar in the American diet,” Nutter said, according to the text of his speech. “On average, Americans drink 20 ounces of soda a day,” he said, adding that Bloomberg’s proposed ban on sugared sodas larger than 16 ounces "is worth evaluating."

Moscow Bans Pride For 100 Years

A Moscow court has banned gay pride events for the next hundred years.
Tverskoy district court ruled lawful the decision of the Moscow municipal government to ban public events that can be qualified as gay parades from March 2012 till May 2112. Nikolay Alekseyev, one of the leaders of the Russian LGBT community and organizer of gay pride events, told reporters that he intended to appeal the decision in the Moscow City Court Presidium, and that if the highest Russian instance also rules against him, to address the European Court of Human Rights. Alekseyev explained to the reporters that in 2011, the activists found a loophole in Russian legislation and submitted requests for 102 gay pride parades to the Moscow Mayor’s office. According to the activist, all they got in return was a letter with a quote from regulations, although the law obliges the city authorities to either allow or ban the planned event within 15 days.

This decision joins four other federal courts that have struck down DOMA under the federal constitution. The statute had been challenged by Edith "Edie" Windsor, who sued the government for failing to recognize her marriage to her partner Thea Spyer, after Spyer's death in 2009. Windsor and Spyer were married in Canada in 2007, and were considered married by their home state of New York.

CALIFORNIA: Homocon Mayoral Candidate Divides San Diego's LGBT Community

On Tuesday Carl DeMaio won the mayoral primary, becomes San Diego's first-ever openly gay finalist for the office. But his candidacy has divided the city's LGBT population.
Despite his sexual orientation, DeMaio has not won the full support of the lesbian, gay, bisexual and transgender community, in part because he never took a stance on Proposition 8, the ballot measure which defined marriage as between a man and a woman. "He's made a statement that almost denies that he's willing to be the ambassador," said LGBT voter Robert Bettinger. However, DeMaio's plan to trim city spending has won him the support of some in the LGBT community. "If you're asking me if a couple of years ago if I'd be supporting a Republican mayor, I'd probably have said no," said Dave McCulloch, an LGBT voter. "He has accepted financial support, both in his council race in 2008 and in his mayoral campaign from individuals who are openly hostile to the LGBT community," said Craig Roberts, who is with San Diego Democrats for Equality.

DENMARK: Gay Marriage Vote Today

Denmark's legislature is expected to approve same-sex marriage today.
Members of the sole house of the Danish parliament are expected to approve the legislation today after an amendment creating a separate system of marriages for gay couples was rejected yesterday. The Evangelical Lutheran Church in Denmark, to which 80 percent of the Danish population belongs, will be able to perform marriage ceremonies under the new laws. New rites were written up by ten of the Church’s eleven bishops in a spirit of “good cooperation”, Bishop Kjeld Holm said.
UPDATE:The bill has passed.
Lawmakers voted 85-24 on Thursday to change Denmark's marriage laws. The law takes effect June 15 and will put Denmark on par with countries such as Iceland and Sweden that allow full wedding ceremonies for gay and lesbian couples. In 1989, Denmark became the first country to allow the registration of gay partnerships. Since 1997 gay couples in Denmark can be wed in special blessing ceremonies at the end of regular church service.

Boy Scouts To Review Ban On Gays


But don't hold your breath.

The Boy Scouts of America will review a resolution that would allow individual units to accept gays as adult leaders, but a spokesman says there's no expectation that the ban on gay leaders will in fact be lifted any time soon. The resolution was submitted by a Scout leader from the Northeast in April and presented last week at the Scouts' national meeting in Orlando, Fla., according to BSA spokesman Deron Smith.

Tony Perkins: Marriage Won Wisconsin

"After tasting the success of Walker's policies, Wisconsin handed its leader an even bigger victory this time (140,000 more votes) than it did in 2010. What changed? No doubt Mayor Barrett's shift on marriage had something to do with it. During the May debate, the Mayor was asked about his stance on same-sex 'marriage'--which Barrett had opposed during his congressional career. Have his own views 'evolved,' the moderator asked, and would he sign a civil unions bill if one were passed in the legislature? 'I believe in marriage equality,' Barrett responded. 'It is an issue where opinions have evolved. And for younger people in particular, they understand the need to respect relationships. I do respect them.'

"Unfortunately for him, voters do respect marriage--so much so that they enshrined it in the state constitution just six years ago. If the Mayor thinks public opinion has changed that quickly, he (and the rest of his party) needs to pay more attention to what's happening in the states: a 22-point victory on marriage in North Carolina, record petition numbers for referendums in Maryland and Washington State, and even marriage-driven defections from the Democratic Party. This was the third gubernatorial recall in history--and Scott Walker is the only one to survive. Could it be that social values were the tipping point in a race that was supposed to be about government spending and the economy? NEW YORK: Another Anti-DOMA Ruling

Metro Weekly's Chris Geidner has the details:
Echoing several other recent court opinions, U.S. District Court Judge Barbara Jones today ruled that the Defense of Marriage Act's federal definition of marriage is unconstitutional insofar as it forced Edie Windsor to pay estate taxes after the death of her wife, Thea Spyer, that would not have been owed had she been married to a man.

The ruling in Windsor's case, which was filed in the Southern District of New York, comes less than a week after a three-judge panel of the U.S. Court of Appeals for the First Circuit unanimously found DOMA unconstitutional under a type of rational basis analysis, affirming a decision earlier reached on more expansive reasoning by U.S. District Court Judge Joseph Tauro.

In a statement reacting to the decision released by her lawyers at the ACLU, Windsor said, "Thea and I shared our lives together for 44 years, and I miss her each and every day. It's thrilling to have a court finally recognize how unfair it is for the government to have treated us as though we were strangers."

Sydney Convicts Win 2012 Bingham Cup

The Sydney Convicts rugby team has won the 2012 Bingham Cup in Manchester, England. Outsports reports:

The Sydney Convicts are bringing the Bingham Cup rugby trophy back to Australia. The Convicts completed a sweep of the tournament this weekend in Manchester, England, winning the A division, 22-5, over the San Francisco Fog and the B division, 13-3, over the Dallas Diablos. "A great day of finals rugby at Bingham cup. Great to see the spirit. Sure the party is gonna be a wild one!!!” tweeted Gareth Thomas, the pro rugby player who came out two years ago. Thomas attended the event along with Ben Cohen, a former elite rugby player and gay ally.

Washington Haters Turn In Petitions

They met the minimum and then some.
Opponents of same-sex marriage on Wednesday submitted an estimated 232,000 signatures to the Secretary of State -- all but guaranteeing that the question of whether gays can marry in Washington will now be decided by voters. Preserve Marriage Washington, the campaign's sponsors, planned to bring in at least 9,000 more signatures by the end of the day. The number of signatures Preserve Marriage Washington gathered for Referendum 74 far exceeds the minimum 120,577 the campaign needs to qualify the measure for the November ballot, and is well above the 150,000 that had been recommended.

California To Investigate NOM

Thank to a persistent campaign of complaints by GOP presidential candidate Fred Karger, the California Fair Political Practices Commission will investigate NOM for campaign finance violations. Via press release from Fred Karger:
In his sworn complaint of May 17th, Karger alleged that NOM did not report over $340,000 that it raised to pass Proposition 8 four years ago. California joins the state of Maine which is in its third year of its investigation of NOM, the leading anti-gay marriage organization in the country.One of the 11 missing contributions was $10,000 from presumptive GOP presidential nominee Mitt Romney’s Alabama PAC. In addition to the Romney money there were 10 more contributions NOM did not report, including: $150,000 from Michael Casey of Jamestown, RI, $100,000 from Sean Fiedler of New York, NY and $25,000 from NOM Board member Craig Cardon of Mesa, AZ, a General Authority in the Church of Jesus Christ of Latter-day Saints (Mormon Church).
