Cliff Kincaid: Impeach Ruth Bader Ginsburg & "Known Lesbian" Elena Kagan

"Our media didn’t treat it as a big deal, but Justices Elena Kagan and Ruth Bader Ginsburg had both officiated at gay weddings. Groups such as the National Organization for Marriage, the American Family Association, the Coalition of African American Pastors, and the Foundation for Moral Law had called for Kagan and Ginsburg to withdraw from the case. Matthew Kidd, executive director of the Foundation for Moral Law, told Accuracy in Media that the failure by Kagan and Ginsburg to withdraw from the case leaves them open to impeachment and removal from the bench. In the case of Kagan, an Obama appointee, she may have had a personal conflict-of-interest. This is a sensitive matter, but various reports indicated that Kagan was a known lesbian before she was nominated to the Court by President Obama. For example, the gay blog QueerTY had identified her as a lesbian. That would mean she was compromised on homosexual issues prior to her ascension to the bench and after she was confirmed. This is a conflict of interest that cannot be tolerated." - Accuracy In Media head Cliff Kincaid, calling on Congress to impeach both justices.

Foundation For Moral Law Files Recusal Demand Against Ginsburg And Kagan

The Foundation for Moral Law, a Montgomery-based nonprofit corporation dedicated to defending the Constitution as understood by its Framers, filed a motion Monday in the United States Supreme Court, urging the recusal of two Justices who have performed same-sex marriages. Canon 3A(6) of the Code of Conduct for United States Judges provides that “A judge should not make public comment on the merits of a matter pending or impending in any court.” 28 U.S.C. sec 455(a) mandates that a Justice “shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.” Because they have performed same-sex marriages, and because Justice Ginsburg has spoken publicly in favor of same-sex marriage, the Foundation contends that those Justices are predisposed to rule in favor of same-sex marriage and are unable or unwilling to consider this case impartially, and that their words and actions give the appearance of bias, if not bias itself. Foundation President Kayla Moore said, ” Common sense dictates that one who has performed same-sex marriages cannot objectively rule on their legality. If these Justices participate in this case, the Court’s decision will forever be questioned as being based on their personal feelings rather than on the Constitution itself. With far less evidence of bias Chief Justice Roy Moore voluntarily did not vote on the recent Alabama Supreme Court case regarding same-sex marriage. Justices Ginsburg and Kagan should follow his example.”

RELATED: Kayla Moore took over as head of the Foundation For Moral Law when her husband Roy Moore was reelected to the Alabama Supreme Court after having been booted from the bench for refusing to remove a Ten Commandments display from his courtroom. Roy Moore's triumphant return was bankrolled by a leader of an SPLC-certified racist hate group who recently "celebrated" the 150th anniversary of the assassination of Abraham Lincoln.

Scott Lively: Christians Must Protest In The Streets For Kagan And Ginsberg To Recuse Themselves From Marriage Case

"The first line of attack is to demand the recusal of both Ginsberg and Kagan, who have performed 'gay wedding' ceremonies, thus invalidating their claim to impartiality, which is a prerequisite to sitting as jurists on any matter. We need a continual presence in front of the U.S. Supreme Court and federal courts in every state demanding that Ginsberg and Kagan recuse themselves. A demand for recusal must be on the lips of every pro-family activist in America and a constant refrain on talk shows, social media and letters to the editor. And if they fail to recuse themselves and by their votes establish a majority opinion 'legalizing' homosexual marriage we must declare the ruling invalid and refuse to recognize it. This article has a political tone, but the threat we face is primarily spiritual. AFA Demands: Kagan And Ginsberg Must Recuse Themselves From Marriage Case

In light of the U.S. Supreme Court’s announcement that it will hear the issue, American Family Association says Supreme Court Justices Elena Kagan and Ruth Bader Ginsburg should recuse themselves from making any same-sex marriage decisions because they have both conducted same-sex marriage ceremonies.

“Both of these justices’ personal and private actions that actively endorse gay marriage clearly indicate how they would vote on same-sex marriage cases before the Supreme Court,” said AFA President Tim Wildmon. “Congress has directed that federal judicial officers must disqualify themselves from hearing cases in specified circumstances. Both Kagan and Ginsburg have not only been partial to same-sex marriage but they have also proven themselves to be activists in favor of it. In order to ensure the Court’s integrity and impartiality, both should recuse themselves from same-sex marriage cases. Congress has an obligation to Americans to see that members of the Supreme Court are held to the highest standards of integrity. The law demands it, and the people deserve it.”
The AFA has also published an action alert which calls on their "one million-plus" supporters to email their members of Congress.

ALABAMA: Christian Group Calls For Elena Kagan & Ruth Bader Ginsburg To Recuse Themselves From Marriage Cases

Kayla Moore, President of the Montgomery-based Foundation for Moral Law, today called upon U.S. Supreme Court Justices Elena Kagan and Ruth Bader Ginsburg to recuse themselves from a case involving same-sex marriage because each of these Justices has personally performed a same-sex marriage. "Justice Kagan's actions are especially improper," Ms. Moore said, "because she performed this same-sex marriage while a case concerning same-sex marriage is pending before the Supreme Court. The State of Utah has filed a petition for writ of certiorari asking the Court to consider an appeal from a 10th Circuit decision invalidating Utah's prohibition against same-sex marriage. The Foundation for Moral Law has filed an amicus brief supporting Utah's petition. By performing same-sex marriages, Justices Kagan and Ginsburg have clearly indicated how they will vote in Utah's case."

Ginsburg stirred further concern September 16 when she told a Minnesota audience that if the Sixth Circuit rules that states may prohibit same-sex marriage, "there will be some urgency" because that would run contrary to a legal trend favoring gay marriage and force the Supreme Court to step in sooner, but if the Sixth Circuit falls in line with other rulings there will be "no need for us to rush." Ms. Moore said Justice Ginsburg's comments were improper because "they not only tip the Court's hand as to how she will vote, but they also constitute a warning to lower courts that they had better rule in favor of same-sex marriage or the Court will step in and reverse them, and the words 'no need for us to rush' imply that she was speaking not only for herself but for the rest of the court. Litigants, lawyers, and the American public can have no confidence in the Court's impartiality unless Justices Kagan and Ginsburg recuse themselves from same-sex marriage cases."
Kayla Moore, NOT incidentally, is the wife of Alabama Supreme Court Chief Justice Roy Moore, who was reelected last year after being booted from that job in 2003 for refusing to remove a Ten Commandments monument from the courthouse grounds. Kayla Moore assumed the group's presidency when its founder, her husband Roy Moore, returned to the bench. Roy Moore has posted the above press release to his Facebook page.

RELATED: Two weeks ago the Foundation For Moral Law filed a SCOTUS amicus brief on behalf of an evil Alabama mother who does not want her late son's husband to be able to inherit her son's estate. The brief was filed by Foundation For Moral Law senior counsel John Eidsmoe, who has a crackpot history that might exceed that of Roy Moore. In 2011 Eidsmoe called for Congress to have "ex-gay" torture provided to the US military. That same year he declared that gay service members will molest children. He has also said that all women must submit to their husbands and that the United States must impose biblical laws and punishments or else the nation is doomed. Eidsmoe, NOT incidentally, was Michele Bachmann's professor at Oral Roberts University.

ALSO RELATED: Last week the Foundation For Moral Law announced that Alabama has approved the sale of the below license plate. The plate costs $50, $41.25 of which will go to the Foundation For Moral Law, who will use the money to keep gay widowers from living in the homes they built with their husbands who were killed in car accidents.

MARYLAND: Supreme Court Justice Elena Kagan Officiates Same-Sex Wedding

Kagan presided on Sunday over the wedding of former clerk Mitchell Reich and Patrick Pearsall in the Washington suburb of Chevy Chase, Maryland. Supreme Court spokeswoman Kathy Arberg said Monday that the same-sex ceremony was the first at which Kagan officiated. Retired Justice Sandra Day O'Connor and Justice Ruth Bader Ginsburg have previously officiated at the wedding of gay and lesbian couples, including at the Supreme Court. Ginsburg most recently performed the wedding of Washington theater director Molly Smith.
When Ginsburg officiated last year, a chorus of outraged sadz erupted from Brian Brown and Matt Barber. The wingnut Charisma News denounced Ginsburg as a "tool of Satan." Stand by, Justice Kagan!
