Ted Cruz Convenes Senate Hearing On "SCOTUS Activism" - Calls Hate Group Leader John Eastman As Witness

Yesterday Ted Cruz convened a hearing before the Senate Judiciary Subcommittee on Oversight, which he chairs, in order to call for reining in the "judicial tyranny" of the Supreme Court. One of the three witnesses he called was NOM chairman John Eastman. MSNBC reports:
Eastman agreed with Cruz’s proposals on judicial term limits and retention elections, but added one more “check” to the judicial branch – that states be given the ability to override “egregiously wrong decisions of the Supreme Court.” Cruz seemed interested in the idea, and asked for Eastman to elaborate. “The massive transfer of power from states to the federal government that came in the wake of the Civil War … unmoored the courts,” Eastman said. “A simple majority of the states ought to be able to override those kinds of decisions of the Supreme Court.”

The irony of such prescriptions was undoubtedly not lost on many of those watching Wednesday’s hearing. In order to correct what Cruz views as a series of decisions that have no basis in the U.S. Constitution, as well as what he considers to be an unconstitutional transgression by the justices into the realm of policy making, Cruz entertained several solutions – such as judicial term limits, retention elections, and state or Congressional overrides of “egregiously wrong decisions” – that would serve to dramatically alter the U.S. Constitution, not restore or strengthen it,

FLORIDA: Rep. Alan Grayson Announces 2016 Senate Bid To Succeed Marco Rubio

Next year’s Florida Senate primary between Reps. Alan Grayson and Patrick Murphy will test whether Sunshine State Democrats are ready to embrace a deep-blue liberal. The contrasts between the two are stark: Grayson is a progressive, hip-shooting firebrand beloved by hardcore liberals; Murphy is a cautious, scripted candidate favored by the Democratic establishment in Washington and Tallahassee. The two Florida congressmen show little admiration for each other, which could presage a brutal and big-spending primary — beginning on Thursday when Grayson officially enters the race to replace Sen. Marco Rubio, who is forgoing a second term to run for president. “Murphy’s people should be scared because the problem with Alan Grayson is he just doesn’t give a damn,” said Screven Watson, a longtime Democratic consultant based in Tallahassee. “Grayson doesn’t do things the way normal candidates do them. His campaigns aren’t normal campaigns. He can raise so much money on the Internet that he’s only second to people like President Obama,” Watson said. “There have been liberal candidates who have run statewide before in Florida, but not like Alan Grayson.”

FRC Celebrates Vote Denying Benefits To Veterans In Non-Marriage Equality States

There may be a consensus in the courts for same-sex "marriage," but not Congress. In a quiet -- but significant -- vote, the Senate made it clear that the legislative branch understands exactly where the people stand on marriage -- and it isn't where the Left would have you believe. During yesterday's vote on the National Defense Authorization Act, the upper chamber took an important step to protect states by blocking an amendment that would have extended gay spousal benefits to veteran couples living in states that haven't redefined marriage. This is an enormous victory, since it was the first time Congress signaled to the Supreme Court where it stands on benefits for same-sex couples who are living in states that don't recognize their marriages.

As part of the Defense debate, Senator Jeanne Shaheen [PHOTO] had been trying for months to leapfrog the Court's decision and invent benefits that -- to this point -- are still unconstitutional. Essentially, the measure would have let the government bypass states that don't recognize same-sex couples as "married" and force them to dole out benefits their own laws reject. At least for now, the President's party has been stopped from tearing down the last two federal holdouts that respect state marriage laws: the social security and veterans' administrations. Unlike other departments, these agencies have consistently recognized marriage for couples based on the state where they live -- not the state where they "married."
The statement goes on to denounce the Republicans who did vote for the amendment.

Senate Rejects Same-Sex Benefits For Veterans In Non-Marriage Equality States

An amendment failed in the Senate on Thursday that would have ensured veterans in same-sex marriages have access to certain spousal benefits wherever they live, although eight Republicans joined Democrats in voting for the measure. Sen. Jeanne Shaheen (D-N.H.) introduced the measure — which is along the lines of her standalone legislation known as the Charlie Morgan Act — on the floor of the Senate during debate on the fiscal year 2016 defense authorization bill. The vote on the measure was 53-42, which was short of the 60-vote requirement needed for passage. U.S. code for veterans benefits looks to the state of residence, not the state of celebration, to determine whether a couple is married.

The eight Republicans who voted for the Shaheen amendment are: Sens. Kelly Ayotte (N.H.), Shelley Moore Capito (W.Va.), Susan Collins (Maine), Ron Johnson (Wis.), Mark Kirk (Ill.), Lisa Murkowski (Alaska), Jeff Flake (Ariz.) and Rob Portman (Ohio). Sens. Ted Cruz (R-Texas) and Rand Paul (R-Ky.), who are pursuing the Republican nomination to run for the White House in 2016, voted against the amendment. Not casting a vote were Sens. Lindsey Graham (R-S.C.) and Marco Rubio (R-Fla.), who are also seeking the Republican nomination. In a statement after the vote, Shaheen vowed to continue the fight to ensure veterans in same-sex marriages have access to spousal benefits wherever they live.
The issue, of course, may be moot very soon.

Thousands Of Sites Block Congress In Protest Against The Patriot Act

Thousands of websites are blocking Congress’s access to their sites in a show of force to protest the Patriot Act. Led by the online activist group Fight for the Future, more than 10,000 sites have added code that redirects any visitors from Internet protocol (IP) addresses from Congress away from their site and towards a protest page. “Congress: This is a blackout,” the site reads. “We are blocking your access until you end mass surveillance laws.” Instead of renewing or reforming the three expiring provisions of the Patriot Act, the activist group wants Congress to let them expire. “The real answer is to end all authorities used to conduct mass surveillance,” Fight for the Future says on the protest page. “Until you do, thousands of websites have blocked your access, and more are joining every day.”
If the Senate does not act by midnight tonight, three major parts of the Patriot Act will automatically expire. Yesterday Sen. Rand Paul penned a TIME op-ed in which he vows to stop reauthorization efforts. See the protest site here.

Rand Paul Vows To Filibuster Patriot Act

Sen. Rand Paul said yesterday that he plans to filibuster against the impending reauthorization vote for the Patriot Act.
"I'm going to lead the charge in the next couple of weeks as the Patriot Act comes forward," he said in a one-on-one interview with the New Hampshire Union Leader. "We will be filibustering. We will be trying to stop it. We are not going to let them run over us. And we are going to demand amendments and we are going to make sure the American people know that some of us at least are opposed to unlawful searches." Paul, the Republican U.S. Senator from Kentucky, said that even architects of the Patriot Act say roving wiretapping by the National Security Agency was not part of the legislation's intent.

Senate Majority Leader Mitch McConnell (Ky.) has said that he favors a full reauthorization of the measures, but other lawmakers say they would be willing to pass reform legislation. A short-term extension would give lawmakers more time to sort out their differences beyond the current June 1 deadline for renewing the law. A filibuster of the Patriot Act provisions could give Paul more visibility as the presidential campaign ramps up. He lists his opposition to the National Security Agency's surveillance programs on the homepage of his website and sells a “NSA Spy Cam Blocker” in his campaign store.

Cyndi Lauper Testifies Before Congress On Behalf Of Homeless LGBT Youth

Yesterday Cyndi Lauper testified before a Senate subcommittee on youth homelessness. After the hearing, she and GOP Sen. Susan Collins discussed the Senate's recent refusal to reauthorize an LGBT-inclusive funding bill. Via the New York Times:
The problem, Ms. Collins said, was “confusion” over parts of the amendment, including a measure misinterpreted as a restriction on faith-based organizations’ ability to show preference in hiring those of their own faith. Ms. Collins pointed out that the Justice Department already provided that protection. She said she hoped to clarify that when and take another crack at passing the measure she originally introduced. “Well, when will that be, do you think?” Ms. Lauper asked. “I don’t know exactly,” Ms. Collins said. “Then what should we do?” Ms. Lauper said. Keep pushing, Ms. Collins responded. But she has yet to discuss another effort to reauthorize the legislation, either as a stand-alone bill or an amendment, with Mitch McConnell, Republican of Kentucky. “Who is that guy?” Ms. Lauper asked. “He is the majority leader,” Ms. Collins said. “He decides what comes to the floor.

Ted Cruz Files Two Anti-Gay Marriage Bills

Days before the U.S. Supreme Court hears arguments on same-sex marriage, Senator Ted Cruz has filed two bills to protect states that bar gay couples from marrying. Cruz's legislation would establish a constitutional amendment shielding states that define marriage as between one woman and one man from legal action, according to bill language obtained by Bloomberg News. A second bill would bar federal courts from further weighing in on the marriage issue until such an amendment is adopted. While Cruz's legislation would face solid opposition in the Senate, it is an attempt to force his competitors to keep the issue alive even if the court rules in favor of same-sex marriage. Last year, Cruz and Utah Senator Mike Lee filed similar legislation to protect more than 30 states that currently define marriage as a union between one man and one woman, but those bills died when the session in a Democratic-controlled congress ended.

Senate Narrowly Rejects Bill To Fund Assistance To Homeless LGBT Youth

Today, the United States Senate failed to pass the Runaway and Homeless Youth and Trafficking Prevention Act (S.A. 290), which would reauthorize the Runaway and Homeless Youth Act (RHYA). The vote was 56 "YES" to 43 "NO" - short of the 60 "YES" votes required to pass. The Act includes a non-discrimination clause that would help ensure lesbian, gay, bisexual, and transgender (LGBT) youth experiencing homelessness not only have access to critical services, but that those services are safe, welcoming, and tailored to meet their unique needs. Research continues to show that while LGBT youth make up just seven percent of the general youth population, they comprise up to 40 percent of the 1.6 million youth that are homeless in America each year. 

"Thank you to the 56 senators who showed true leadership today by voting in favor of protecting all of our nation’s 1.6 million homeless youth,” said Cyndi Lauper, Co-Founder of the True Colors Fund. “Unfortunately, 43 senators put the objections of conservative religious groups ahead of the lives of our nation’s most vulnerable youth. Every day, homeless gay and transgender youth experience rejection and discrimination from their families, communities, and the providers who are supposed to help them. Today, 43 senators added their names to the group of people who think that it is acceptable to throw away the up to 40% of homeless youth who identify as LGBT."

For the third time this year, a majority of the Republican-led Senate voted for a pro-LGBT measure — with 56 senators, including 10 Republicans, voting for an amendment that including LGBT protections for runaway youth. Wednesday’s vote to amend the Runaway and Homeless Youth and Trafficking Prevention Act into the Justice for Victims of Trafficking Act of 2015 failed, however, as it would have required 60 votes to pass. The amendment included a nondiscrimination clause that would have prohibited runaway and homeless relief programs created by the act from discriminating against LGBT children based on their sexual orientation and gender identity.

Sens. Kelly Ayotte, Shelley Moore Capito, Susan Collins, Dean Heller, Mark Kirk, Lisa Murkowski, Rand Paul, Rob Portman, Dan Sullivan, and Pat Toomey joined all the Democrats in voting for the measure, which was brought to a vote by Sen. Pat Leahy. Among the declared presidential candidates, Paul was the only one to vote for the measure. Sen. Marco Rubio opposed the amendment, and Sen. Ted Cruz did not vote on the amendment or the underlying bill, which passed 99-0. This was not the first such vote, suggesting that, while there is still not yet a filibuster-proof majority supporting LGBT rights in the Senate, there is a simple majority who appears willing to back a broad range of LGBT rights measures. In many cases, however, the Republican leadership’s opposition to LGBT rights measures would keep them from coming to the floor.

Marco Rubio: I'd Attend A Gay Wedding

“If there’s somebody that I love that’s in my life, I don’t necessarily have to agree with their decisions or the decisions they’ve made to continue to love them and participate in important events,” Rubio said. He compared it to attending “second marriages,” which are not strictly allowed the Catholic faith. “If it’s somebody in my life that I care for, of course I would,” Rubio reiterated on the question of attending gay weddings. “I’m not going to hurt them simply because I disagree with a choice they’ve made or because I disagree with a decision they’ve made, or whatever it may be.” “Ultimately, if someone that you care for and is part of your family has decided to move in one direction or another or feels that way because of who they love, you respect that because you love them,” he concluded. Again, he compared the union of a same-sex couple to the divorce of a straight one. “If someone gets divorced, I’m not going to stop loving them,” he said.

Cory Booker To Host SCOTUS Marriage Plaintiff Jim Obergefell On Senate Floor

SCOTUS marriage plaintiff Jim Obergefell will join Sen. Cory Booker on the Senate floor today. Via press release:
Today, Sen. Cory Booker (D-NJ) will deliver remarks on the Senate floor underscoring the importance of marriage equality and sharing the story of Jim Obergefell’s struggle to have his late husband’s legal marital status acknowledged on his state-issued death certificate - a right that has been challenged by the state of Ohio all the way to the Supreme Court. Jim Obergefell is now the lead petitioner in Obergefell v. Hodges, a consolidation of six cases from four states—which addresses the question of whether the Fourteenth Amendment requires a state to recognize a same-sex marriage licensed in another state. The Supreme Court will hear oral arguments on April 28, 2015.

Eleven Senate Republicans Vote For Benefits For Married Same-Sex Couples

Eleven Senate Republicans joined with all of the Democrats on Thursday night in supporting an amendment to guarantee equal Social Security and veterans benefits to married same-sex couples — even if they live in a state that does not recognize such marriages. The vote was one of many, nonbinding Senate votes of a broad range of hot-button issues for a budget that might not even pass the upper chamber.

Nonetheless, the vote gives rare insight into the potential changes going on within the Republican Party on the marriage issue in advance of the coming Supreme Court decision widely expected to hold that bans on same-sex couples’ marriages are unconstitutional. Six of the 11 Republicans voting for the measure are up for re-election in 2016.

The amendment, proposed by Sen. Brian Schatz, addressed the fact that both Social Security and some provisions of veterans’ benefits are, by statute, provided to spouses on the basis of whether a couple’s marriage is recognized by the state in which they live. The amendment would provide for benefits for spouses for all married same-sex couples, regardless of where they live.
Also voting "yes" was Sen. Joe Manchin (WV), the lone Senate Democrat yet to endorse same-sex marriage. Hit the link for the list of Republicans.

Sen. Harry Reid To Retire In 2016

The New York Times has the big news:
Senator Harry Reid, the tough tactician who has led Senate Democrats since 2005, will not seek re-election next year, bringing an end to a three-decade congressional career that culminated with his push of President Obama’s ambitious agenda against fierce Republican resistance. Mr. Reid, 75, who suffered serious eye and facial injuries in a Jan. 1 exercise accident at his Las Vegas home, said he had been contemplating retiring from the Senate for months. He said his decision was not attributable either to the accident or to his demotion to minority leader after Democrats lost the majority in November’s midterm elections. “I understand this place,” Mr. Reid said. “I have quite a bit of power as minority leader.”

His departure at the end of 2016 will create an opening both at the top of the Senate Democratic hierarchy and in a Senate contest that would have been a megaspending slugfest in the presidential battleground of Nevada. Conservatives such as Charles G. and David H. Koch, the billionaire brothers who were a favorite target of Reid criticism in 2014, would have spared no expense in trying to oust him. Senator Charles E. Schumer of New York, who helped Democrats capture the Senate in 2006 and has led their political messaging operation, is considered the favorite to succeed Mr. Reid as party leader. Senator Richard J. Durbin of Illinois, the Senate’s No. 2 Democrat, could also be a contender for the job, but it is unclear how strongly he would pursue it.

Ted Cruz Defends Letter To Iran

"I guess the question I have first is, was the intention of the letter to get in the way of a negotiations as it is proved to?" Brzezinski asked Cruz. "Look, the intention of the letter was two things. Number one, to defend our national security. I think this deal that is being negotiated by the Obama administration is profoundly dangerous," he said. Brzezinski interrupted: "So it was intended to get in the way of the deal?" "It was intended to stop a bad deal," he shot back. "Absolutely." The two went back and forth as Brzezinski repeatedly brought Cruz back to the results the letter was having on the nuclear talks. "To interfere with a negotiation with Iran and to actually possibly even undermine a deal in the making? Basically the next step to that is to just get right down the road to war," she said.

Charlie Crist: I Might Run For Senate Again

Charlie Crist is considering another run for the U.S. Senate, in the 2016 race. "Well, I have been encouraged to," Crist said Wednesday when asked by phone about reports that he might run again. Crist, who is in New York, declined to elaborate. Crist, a former Republican governor of Florida, ran for the Senate in 2010 as an independent, losing handily to Republican Marco Rubio, but finishing ahead of Democrat Kendrick Meek. In 2013 he formally changed his party affiliation to Democrat and last year ran again for governor, losing to incumbent Republican Gov. Rick Scott in a close race. There is a chance that Rubio will not seek re-election. He has repeatedly said that if he decides to run for president, he would not seek re-election to the Senate.
Other potential Democratic candidates for Rubio's Senate seat are U.S. House members Debbie Wasserman-Shultz, Alan Grayson, and Patrick Murphy. Among the potential candidates on the GOP side is Florida Attorney General Pam Bondi.
