More Corporate Support For Equality Act

Four new major American companies have become the latest to endorse the Equality Act, federal legislation that would establish full, federal equality for all LGBT Americans. In doing so, these leading companies - IBM, Oracle, Orbitz, and Symantec - made clear that they believe all LGBT Americans should have the protections from discrimination in federal law that they deserve. They join American Airlines, Apple, The Dow Chemical Company, Facebook, General Mills, Google, Levi Strauss & Co., Microsoft, and Nike as part of a national business coalition supporting comprehensive, federal LGBT non-discrimination protections. Additionally, Hewlett-Packard in Fortune recently announced its support for the Equality Act.

STATEMENT BY IBM: “IBM’s workplace culture is built on the principles of non-discrimination and equal opportunity for all. We established a corporate policy on equal opportunity more than a decade before the Civil Rights Act. We championed an industry-leading policy of non-discrimination based on sexual orientation over 30 years ago, and expanded it in 2002 to cover gender identity and expression. IBM is proud to support the Equality Act and maintains our steadfast support for all employees to experience equality in the workplace."

STATEMENT BY ORBITZ: “At Orbitz we’ve been advocates of equality and inclusion since our founding in 2001. Our support for the Equality Act is consistent with our other actions, such as signing the amicus brief calling on the Supreme Court to find gay marriage bans unconstitutional.”

STATEMENT BY SYMANTEC: “At Symantec, we are proud to support full and equal rights for the LGBT community. We believe having a diversity of perspectives ensures we make better business decisions and the products and services we offer meet the needs of the broad spectrum of people we serve worldwide, which is why we couldn’t be more proud to support the expansion of legal protections. We unequivocally support the Equality Act – for the future of our business and society.”

As I've mentioned before, the Equality Act will see little traction in the current GOP-dominated Congress, but this early groundwork is critical to what most consider to be the "heaviest lift" in our movement's history.

USDA To Host Rural Pride

The US Department Of Agriculture and the National Center for Lesbian Rights will hold a Rural Pride event in Jackson, Mississippi on August 14th. 

 #RuralPride is a series of summits across the country to elevate the voices of LGBT people and families in rural communities, explore how these communities are particularly vulnerable, and discuss proposed and enacted federal policy changes that can increase equality and access for rural LGBT people and their families. The #RuralPride summits center on LGBT experiences in rural America, including increased rates of economic insecurity, lack of family and nondiscrimination protections, the relationship between LGBT and faith communities, and the heightened challenges facing rural LGBT youth and rural LGBT people of color. The #RuralPride summit series is a partnership between NCLR and USDA that challenges the stereotype that LGBT people only live in metropolitan areas by raising awareness of the particular issues faced by LGBT rural communities.

Feds Investigate Lion-Killing Dentist

But does Zimbabwe even want him? Via Reuters:

"What lion?" acting information minister Prisca Mupfumira asked in response to a request for comment about Cecil, who was at that moment topping global news bulletins and generating reams of abuse for his killer on websites in the United States and Europe. The government has still given no formal response, and on Thursday the papers that chose to run the latest twist in the Cecil saga tucked it away on inside pages. One title had to rely on foreign news agency copy because it failed to send a reporter to the court appearance of two locals involved. For most people in the southern African nation, where unemployment tops 80 percent and the economy continues to feel the after-effects of billion percent hyperinflation a decade ago, the uproar had all the hallmarks of a 'First World Problem'.

Perhaps the feds are acting because the petition launched by JMG participant Scott Wooledge has now exceeded the threshold that results in an official White House response.

Major Corporations Back Equality Act

Today the Equality Act, a comprehensive federal LGBT rights bill, will be introduced in Congress. The Human Rights Campaign has already brought three major corporations on board. Via press release:

STATEMENT BY APPLE – “At Apple we believe in equal treatment for everyone, regardless of where they come from, what they look like, how they worship or who they love. We fully support the expansion of legal protections as a matter of basic human dignity.”

STATEMENT BY THE DOW CHEMICAL COMPANY – “Dow applauds the introduction of the Equality Act and continues to support a comprehensive federal framework that ensures fairness and opportunity for everyone. Full inclusion of our LGBT colleagues and citizens is quite simply the right thing to do – for business and for society.”

STATEMENT BY LEVI STRAUSS & CO. – “Levi Strauss & Co. is proud to support the Equality Act. We have a long history of supporting LGBT equality, and the time has come in this country for full, federal equality for the LGBT community. Ensuring fairness in our workplaces and communities is both the right thing to do and simply good business.”

Each of the three major companies scored a perfect 100 on HRC’s annual Corporate Equality Index (CEI), a nationally recognized benchmark of LGBT inclusion in the workplace, and were recognized on HRC’s list of Best Places to Work for LGBT Equality in 2015.

“These remarkable companies have proven once again their tremendous leadership on behalf of LGBT Americans,” said HRC President Chad Griffin. “Time and again, these leaders of Corporate America have asked 'what more can we do?,' and each time they’ve stepped up to the plate and delivered. As the fight for full, federal equality enters a new chapter, I am tremendously thankful that we have these champions standing shoulder to shoulder with us.”

Yesterday winning Prop 8 attorneys Ted Olson and David Boies also endorsed the bill. Most believe that the Equality Act will see little traction in either GOP-dominated chamber.

Where Liberty University Gets Its Money

Liberty University is not just your average school down the road. The once small Christian college founded in 1971 by the Rev. Jerry Falwell now has the largest student body of any private nonprofit university in the country. With over 70,000 students, the university has become a destination for political candidates seeking the GOP’s more conservative favor. Sen. Ted Cruz (R-Tex.) kicked off his campaign during a convocation at Liberty. In May, former Florida governor Jeb Bush (R) followed in the footsteps of John McCain and Mitt Romney by giving Liberty’s commencement address. The irony: The exponential growth of Liberty University has been fueled by billions in federal student aid made possible by President Obama and congressional Democrats. In the late 1990s, Liberty students received less than $20 million in aid. Students now receive over $800 million dollars a year in federal aid. As with any federal financial aid, the grants and loans are awarded to students, not the university. Liberty does not receive any other federal funds, but its growth has come by attracting Christian students who qualify for aid.

"On Friday, the Equal Employment Opportunity Commission made a remarkably lawless decision: it unilaterally added 'sexual orientation' to the Civil Rights Act of 1964, something wholly unjustified by the text, by the history, or by the plain meaning of the statue, hijacking the civil rights movement in a profound new way. Everyone knows the Civil Rights Act of 1964 does not include sexual orientation. Even the gay rights movement knows it, because they proposed adding employment discrimination by statute, the Employment Non-Discrimination Act (ENDA), and even adding sexual orientation to the ’64 Act. Now, unless Congress acts, every religious school, charity, and parachurch organization must hire openly gay people, or face potential backbreaking litigation. Will Kennedy overturn this ruling? Jeb Bush Backs Workplace & Housing Protections For LGBT Citizens (But Only On A State-By-State Basis)

Jeb Bush spoke to staffers at a San Francisco tech startup yesterday where he declared that workplace and housing discrimination protections for LGBT Americans should be enacted, but on a state-by-state basis.

An employee who identified himself to Bush as being gay asked about Bush’s position on legislation to ban discrimination of LGBT Americans. “I don’t think you should be discriminated because of your sexual orientation. Period. Over and out,” he replied.

Bush continued: “The fact that there wasn’t a law doesn’t necessarily mean you would have been discriminated against.” He added that in the wake of the Supreme Court decision to legalize same-sex marriage nationwide, the country must work to carefully balance the rights of those seeking to marry and the religious beliefs of those who oppose those unions.

Citing the frequently-used example by religious freedom advocates, Bush said that in the case of a florist approached by a gay couple, “you should be obligated to sell them flowers, doing otherwise would be discriminatory.” But he said that the objecting florist should not be required to participate in the wedding, a fine line that he hopes will appeal to all sides of the debate.

When the employee followed up to ask specifically whether he would support anti-discrimination laws for LGBT Americans for their housing and employment—the next target for gay rights marriage advocates—Bush said he would at the state level. “I think this should be done state-by-state, I totally agree with that,” he said.

Feds Beef Up LGBT Senior Protections

As part of the White House Conference on Aging today, the U.S. Department of Housing and Urban Development (HUD) issued guidance to better serve and help avoid discrimination to LGBT Americans seeking HUD-assisted or HUD-insured housing. The guidance will help clarify the Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity Rule (Equal Access Rule), which was originally published in 2012. The Equal Access Rule ensures that housing across HUD programs is open to all eligible individuals regardless of actual or perceived sexual orientation, gender identity or marital status, including Section 202 Supportive Housing for the Elderly. “Every American deserves to live with dignity, regardless of who they love or who they are,” said HUD Secretary Julián Castro. “HUD is committed to fighting unjust discrimination and to expanding housing opportunity for all.”

And if you screw with LGBT seniors: "HUD may pursue any available remedy, including sanctions, that it determines appropriate to remedy the violation." BOOM.

Attorney General Loretta Lynch Announces Full Federal Marriage Benefits Nationwide

"Following the Supreme Court’s historic decision in Obergefell that every couple has the same right to participate in the institution of marriage, whether the partners are of the same-sex or opposite sexes, I directed Justice Department staff to work with the agencies to ensure that the ruling be given full effect across the federal government. Thanks to their leadership and the quick work of the Social Security Administration and the Department of Veterans Affairs, today I am proud to announce that the critical programs for veterans and elderly and disabled Americans, which previously could not give effect to the marriages of couples living in states that did not recognize those marriages, will now provide federal recognition for all marriages nationwide. The agencies are currently working towards providing guidance to implement this change in law.

Obama To Expand Overtime Coverage

The Obama administration is unveiling long-awaited new rules that would allow more workers to claim overtime pay. Currently, certain workers who make more than $23,660 cannot claim overtime; the new proposal would raise that threshold to $50,440 per year. "Right now, too many Americans are working long days for less pay than they deserve," President Obama writes in an op-ed for The Huffington Post. "That's partly because we've failed to update overtime regulations for years." The new Labor Department regulations would affect up to 5 million workers. Many workers who make more than $23,660 a year are exempted from overtime benefits because they are are designated as management or administrative personnel.

The National Retail Federation plans to fight the change.

Yahoo News Documentary: Uniquely Nasty: The US Government's War On Gays

As the U.S. Supreme Court prepares to rule on same-sex marriage, Yahoo News presents a new 30-minute documentary, “Uniquely Nasty: The U.S. Government’s War on Gays,” reported and narrated by chief investigative correspondent Michael Isikoff. The film explores a dark and little-known chapter in America’s recent political past, when gays and lesbians were barred from working for the federal government and the FBI, through its“sex deviates” program, secretly collected hundreds of thousands of files on the sex lives of American citizens. “Uniquely Nasty” includes never-before-seen government memos by legendary FBI director J. Edgar Hoover (read by George Takei) and John Steele, a top lawyer for the U.S. Civil Service Commission (read by Matt Bomer) asserting that gays were “not suitable” for federal employment. “Uniquely Nasty” is divided into three chapters.

The beginning of the film deals with George W. Bush.

Woman To Be On New $10 Bill

CNN Money reports:

On Wednesday, U.S. Treasury Secretary Jack Lew said a woman will be featured on a redesigned $10 bill in 2020 -- the 100th anniversary of the Constitution's 19th Amendment, which gave women the right to vote. A decision on who the woman will be won't be made for several months. The last woman on U.S. paper currency was Martha Washington, who was on the $1 Silver Certificate between 1891 and 1896. "We have only made changes to the faces on our currency a few times since bills were first put into circulation, and I'm proud that the new 10 will be the first bill in more than a century to feature the portrait of a woman," Lew said. Lew, who will make the final decision on who will grace the currency, is asking the public for help. The department will launch a website, and is asking for input over social media with the hashtag #TheNew10. What's his criteria? Lew wants the next generation of U.S. currency to underscore the theme of American democracy. The portrait must also -- by law -- be of someone who is no longer living.

Alexander Hamilton has been on the $10 bill since 1929.

Special US Envoy On LGBTI Rights Randy Berry To Begin Tour Of Latin America

Special Envoy for the Human Rights of LGBTI Persons Randy Berry will travel to Chile from June 1 – 2, Argentina from June 3 – 4, Uruguay from June 4 – 5, Brazil from June 6 – 9, and the Dominican Republic from June 10 – 11 to discuss the human rights of LGBTI persons and other historically marginalized groups. During the 11 day visit, Special Envoy Berry will participate in LGBTI Pride Month activities and meet with government representatives, in addition to members of religious, business, academic, and civil society organizations.

REPORT: Pentagon Set To Add Sexual Orientation As A Protected Class

The Pentagon is preparing to update its Military Equal Opportunity Policy to include sexual orientation as a protected class and the change could be made final as soon as the end of next month, the Washington Blade has learned. A senior defense official, who spoke on condition of anonymity, confirmed late Friday the Defense Department is planning to update the Military Equal Opportunity Policy to add the words “sexual orientation” as part of the non-discrimination policy.

The proposed change is set to be delivered as early as the middle of next week to Defense Secretary Ashton Carter for his review and final approval, the official said. Each of the military services has already agreed to the change, the official said. The planned change follows an internal review at the Pentagon of the Military Equal Opportunity Policy, which the official said lasted about 12 months. Efforts to include sexual orientation in the revision were languishing, but were re-energized after the appointment in April of Brad Carson as under secretary of defense for personnel and readiness, the official said.

The Military Equal Opportunity Policy identifies classes of service members that should be protected from discrimination to allow them to rise to highest level or responsibility possible. As it stands, the Military Equal Opportunity Policy includes race, color, religion, age, physical or mental disability, sex and national origin. However, service members as of right now have no recourse for anti-gay discrimination outside of their chain of command.

FEDS: Start HIV Treatment Immediately

The federal government has halted a large clinical trial on early HIV treatment because results already in conclusively show that newly diagnosed patients do best if they start on anti-retroviral therapy immediately. Via the New York Times:

The study was stopped more than a year early because preliminary data already showed that those who got treatment immediately were 53 percent less likely to die during the trial or develop AIDS or a serious illness than those who waited. The study is strong evidence that early treatment saves more lives, the officials said. Fewer than 14 million of the estimated 35 million people infected with H.I.V. around the world are on treatment now, according to U.N.AIDS, the United Nations AIDS-fighting agency. In the United States, only about 450,000 of the estimated 1.2 million with H.I.V. are on treatment, according to the Centers for “This is another incentive to seek out testing and start therapy early, because you will benefit,” said Dr. Anthony S. Fauci, director of the National Institute for Allergy and Infectious Disease, which sponsored the trial. “The sooner, the better.”

Many HIV/AIDS advocacy groups have long said that treatment should start immediately. New York City's Department of Health began advising immediate treatment in 2011.

Feds to Induct Gay Rights Pioneer Frank Kameny Into Labor Hall Of Honor

Frank Kameny, who for decades fought to end discrimination in the federal workplace, will be honored by the U.S. Department of Labor in June with an induction to its Hall of Honor. Kameny's legacy as a civil rights leader has made a monumental difference in improving the lives of all workers all across America. A World War II veteran and Harvard-educated doctor of astronomy with the U.S. Army Map Service, Kameny was discharged and barred from federal government employment in 1958 after U.S. Civil Service Commission investigators asked if he was a homosexual.

Kameny fought the injustice, eventually taking his case to the U.S. Supreme Court, which denied his petition in 1961. The setback led him to become a co-founder of the first gay rights organization in Washington, D.C., and began his tireless fight to force the nation's largest employer — the federal government — to end discrimination in its employment practices based on sexual orientation. "Frank Kameny was a groundbreaking leader in the LGBT civil rights movement. He fought tirelessly to live out his truth and to end workplace discrimination," said Secretary of Labor Thomas E. Perez. "At the Department of Labor we work every day to carry on his legacy and ensure that all workers, no matter who they are or who they love, have equal access to opportunity."

Kameny died at age 86 in 2011. Earlier Hall Of Honor inductees include Ted Kennedy, Bayard Rustin, Mary Harris "Mother" Jones, and the 9/11 Rescue Workers. Cancer Charities Hit With Fraud Charges, Feds Say They Stole $187M From Donors

Charities that claimed their funds were helping patients fighting cancer but were actually spending the bulk of donations on vacations, concerts and other luxurious perks are facing federal charges that they stole more than $187 million from consumers in one of the biggest charity fraud cases ever filed. The Federal Trade Commission, along with law enforcement officials throughout the U.S., filed the complaint against the Cancer Fund of America, Children's Cancer Fund of America, The Breast Cancer Society and Cancer Support Services, along with several of those organizations' executives.

"The defendants' egregious scheme effectively deprived legitimate cancer charities and cancer patients of much-needed funds and support," Jessica Rich, director of the Federal Trade Commission's Bureau of Consumer Protection, said in a statement. "The defendants took in millions of dollars in donations meant to help cancer patients, but spent it on themselves and their fundraisers. I'm pleased that the FTC and our state partners are acting to end this appalling scheme."

The Children's Cancer Fund of America and its president and executive director, Rose Perkins [PHOTO], along with The Breast Cancer Society and its executive director, James Reynolds II, and Cancer Support Services' chief financial officer, Kyle Effler, have agreed to settle the charges that they are facing. The three executives will be barred from managing charities, fundraising and overseeing charity assets. The Children's Cancer Fund of America and The Breast Cancer Society will also go out of business. The other parties in the complaint will continue to face legal action.

US Rep. Ted Lieu To Introduce Bill To Ban "Ex-Gay" Torture As Fraudulent Practice

On Tuesday morning, Democratic Rep. Ted Lieu of California will introduce a federal bill to ban commercial efforts to change people’s sexual orientation or gender identity — often called conversion therapy. “The public views conversion therapy as quackery, as something that harms people,” Lieu told BuzzFeed News on Monday afternoon, just after landing back in D.C. from California. “Eventually, I believe Congress will catch up to that, but you do need to start somewhere, so that’s why we’re introducing this legislation.” He faces an uphill battle: The legislation, which would label conversion therapy an “unfair or deceptive act or practice” that would be illegal under the Federal Trade Commission Act, is being introduced with less than three dozen co-sponsors — all of whom are Democrats. Lieu does, however, have a powerful ally in his effort. Minority Leader Nancy Pelosi has signed on as an original co-sponsor of the bill.

While a state Senator in California, Lieu was behind his state's successful ban on the "ex-gay" torture of those under age 18. His federal bill, however, would not limit the ban to minors. Lieu tells Buzzfeed, "Fraud is fraud, whether you practice it on a 16-year-old or a 45-year-old." The SPLC is currently suing an "ex-gay" group in New Jersey on the same grounds.

US Denounces Gambian President Over Vow To "Slit The Throats" Of Gay Men

Several days ago Gambian President Yahya Jammeh vowed to "slit the throats" of gay men, adding, "If you are a man and want to marry another man in this country and we catch you, no one will ever set eyes on you again, and no white person can do anything about it." Yesterday US National Security Adviser Susan Rice denounced Jammeh.

“We condemn his comments, and note these threats come amid an alarming deterioration of the broader human rights situation in The Gambia,” Rice said in a statement. “We are deeply concerned about credible reports of torture, suspicious disappearances – including of two American citizens – and arbitrary detention at the government’s hands.” Rice made the remarks in a statement one day before the International Day Against Homophobia & Transphobia, saying the remarks from Gambia President Yahya Jammeh underscore the need for continued efforts “to seek a world in which no one lives in fear of violence or persecution because of who they are or whom they love.” Jemmeh, who’s been in power since 1994 and survived a coup attempt on December 30, issued a warning to gay men in the Wolof language during a recent rally in which he also threatened the political opposition, according to a translation of his remarks obtained by the international news agency Vice News.

In October 2014 Jammeh signed a bill which makes homosexual acts punishable by life in prison.
