Equality California Endorses Hillary

Via press release:
California, the nation's second largest lesbian, gay, bisexual and transgender membership organization, has endorsed Hillary Rodham Clinton in the 2016 presidential election. EQCA is the first major LGBT organization in the nation to endorse the former Secretary of State for President. "We want Hillary Clinton to run and are ready to mobilize our 800,000 members to help her win," said Equality California's Executive Director Rick Zbur. "We're enthusiastic about her candidacy because she has the best record of accomplishment on LGBT issues of any potential candidate. Equality California is ready for Hillary!"

As Secretary of State, Clinton championed the rights of LGBT people around the world, making LGBT rights and acceptance a global priority. In 2011, Sec. Clinton gave a historic speech on International Human Rights Day at the United Nations in Geneva, saying: "Gay rights are human rights, and human rights are gay rights." Under Sec. Clinton's leadership, the Department of State used its full range of diplomatic and development tools to combat violence and discrimination against LGBT people worldwide. Thanks to her efforts, LGBT rights became a core principle of U.S. foreign policy in an unprecedented way.

Petition Of The Day

From Equality California:
When the President acknowledges your love during his inaugural address, when he makes your equality a benchmark of America’s promise, when he draws commonality from our struggle for dignity and justice to Seneca Falls and Selma, it is impossible not to surge with gratitude and wonder at the progress we have made within the span of a generation.

But, as President Obama said, our journey is not complete. We cannot yet enjoy the freedoms promised; while we can see the hill, we can’t yet rest there.  For all of us who heard those powerful words yesterday, thankful and hopeful, we can now help President Obama take the next step on our journey, a journey that is incomplete until all Americans can marry the person that they love.

Please, take a moment and urge President Obama to file an amicus brief in Hollingsworth v. Perry, the Proposition 8 case. He knows that this is the path the country must take to achieve the promise of equality; take a moment to encourage his hand to follow his heart.
Sign the petition.

CALIFORNIA: Hate Groups Now Pushing FIVE Anti-Gay Ballot Measures

Equality California last night sent out the above alert. It's apparent that hate groups have decided to simply overwhelm the good guys with a high number of attacks. It would likely cost tens of millions of dollars to defend against all five measures. We'll have to see if the other side has the financial backing to push them through.

CALIFORNIA: Hate Group Launches Two Campaigns To Thwart Gay History Bill

Unswayed by their failure to gather enough signatures to place a repeal of SB 48 on the November 2012 ballot (despite illegal tactics), a Christianist hate group has launched two new campaigns to thwart the plan to educate school kids about influential LGBT figures from history.

The first new plan, which I told you about earlier this month, attempts to strike the words "gay, lesbian, bisexual, and transgender" from the bill. The Bay Area Reporter reports that the second plan would allow parents to opt-out of any lessons about LGBT people.

EQCA spokeswoman Rebekah Orr said the new campaign "is likely to be an even uglier effort than their previous one. "It's very specifically targeted at LGBT people. It makes extremely clear what their motivations are," Orr said. Richard Rios, the chair of the Christian Coalition of California, submitted the two anti-gay proposals. In an interview, he said, "It's not a homophobic issue. It's an issue of the requirement of the teaching of something that's contradictory to one's faith." Asked about how teaching the historical contributions of someone like slain gay icon Harvey Milk would contradict someone's religious beliefs, Rios invoked same-sex relationships. He said that in his upbringing, he learned that any relationship other than that between a man and a woman "is not a godly relationship."
RELATED: The above-linked BAR story notes the leadership vacuum currently plaguing Equality California, who some say will be ill-prepared or unable to mount a defense of SB48. Following the departure of their second executive director in several months, EQCA has hired former GLAAD head Joan Garry as its interim leader. A spokesman for EQCA estimates that a defense of SB48 could cost as much as $35M, depending on what resources our enemies can muster.

New Head Of EQCA Resigns

Recently appointed Equality California executive director Roland Palencia has resigned less than five months after replacing Geoffrey Kors. Via press release:
"Equality California serves a critical role in the movement for lesbian, gay, bisexual and transgender (LGBT) equality in the state of California," said Palencia. "Over the next year, the movement in California faces a unique set of challenges that demands leadership uniquely positioned to take those challenges head-on, strengthen the organization and bring together the diverse parts of our movement into a powerful force for change. It's been my privilege to serve as the Executive Director of Equality California and I will continue to be an avid and involved supporter of EQCA and its work for equality."
Last week the group announced that it would not pursue placing a repeal of Proposition 8 on the 2012 ballot.

EQCA: No Prop 8 Repeal Try In 2012

Citing polls that are still too close to call, Equality California has announced that they will not attempt to place a repeal of Proposition 8 on the 2012 ballot.
Equality California said that while public opinion on marriage for same-sex couples has increased since Proposition 8 passed in 2008, support continues to hover near 50 percent—indicating more work must be done before asking voters to overturn Proposition 8 through what would inevitably be a very expensive and difficult campaign. In addition, the Perry v. Brown legal challenge to Proposition 8 has provided hope that the freedom to marry can be restored in California and create a legal precedent to protect marriage without the potential risks and expense of a multi-million dollar campaign in these very trying economic times.

"With a challenge to Prop 8’s discrimination now before the courts, Freedom to Marry supports Equality California’s decision to forego a ballot campaign in 2012,” said Evan Wolfson, founder and President of Freedom to Marry. ”Freedom to Marry will continue to work with Equality California and our many other partners to engage Californians in the crucial conversations necessary to grow the pro-marriage majority and permanently restore the freedom to marry in California as soon as possible."

EQCA: We'll Lose SB 48 At Ballot

The new head of Equality California says that the prospect of thwarting a repeal of the LGBT education bill does not look good.
It may not be what the LGBT community wants to hear, but Equality California Executive Director Roland Palencia was quite blunt on a conference call with reporters last week when he acknowledged that should the referendum to overturn Senate Bill 48, the FAIR Education Act, make it to the ballot, we will lose. "The prospects are not good if this gets to the ballot," Palencia said. "I am not under any illusion." Right now the anti-gay groups that spearheaded Proposition 8 are gathering signatures to get the SB 48 referendum on the ballot next year. They have until October 12 to collect 504,760 valid signatures. According to EQCA and its coalition partners, much of that work is currently taking place in churches – no surprise there – but the prospect of hired signature gatherers sprouting up outside big box stores in the final push is very real.

Equality California: Should We Take Proposition 8 Back to The Ballot In 2012?

Equality California says that since it may be years before Prop 8 is resolved in federal court, it's time to talk about attempting its repeal on next year's ballot. Via press release:
Because legal experts are advising that the Proposition 8 federal challenge could take years to resolve, Equality California is launching a community engagement initiative to start a discussion on whether to return to the ballot in 2012 to repeal the marriage ban or whether to wait for a final decision by the courts. Before making any recommendation, Equality California will survey its membership, hold 10 town halls across the state and an online town hall, conduct a poll of likely 2012 voters, consult with political experts, coalition partners and engage with its members and the LGBT community. Equality California will announce results of polling and analysis by Labor Day. Details and a complete schedule for community town halls are forthcoming with initial meetings scheduled for San Francisco on May 19, West Hollywood on May 25 and San Diego on June 2.
A small but dogged campaign to place a repeal of Prop 8 on the 2010 ballot ultimately collapsed without the support of major groups like Equality California.

Prop 8 Reactions

Lambda Legal
"Because the federal appeals judges said they need clarification, we look forward to a decision by the California Supreme Court confirming that initiative proponents lack legal standing to continue the Perry case. They are not law enforcers, and have the same limited rights as everyone else to litigate only when their own rights are at stake, not merely to assert their opinions about others' rights." Initiative proponents also cannot step into the shoes of the attorney general, the governor or other state officials. The reason for this is basic: the governor and attorney general are elected by the people to represent all the people, not just one point of view on one issue, out of countless, competing concerns. Most importantly, state officials swear an oath to uphold the federal and state constitutions, including their abiding promises of equal protection and due process for everyone. Initiative proponents take no such oath, and have no such duties.
AFER
“More than six months ago, the federal district court declared unequivocally that Prop. 8 is unconstitutional and that it causes grave harm to gay and lesbian couples and their families each day that it is in effect. We look forward to assisting the California Supreme Court reach an answer to the question before them so that the 9th Circuit Court of Appeals can affirm the district court’s ruling and end the state-sanctioned discrimination of Prop. 8. The American Foundation for Equal Rights is committed to achieving the freedom to marry for all Americans. We look forward to taking this case to the U.S. Supreme Court, which 14 times before has declared that marriage is a fundamental right for every American.”
NCLR
For same-sex couples waiting to marry, and for all LGBT Californians waiting to be treated as equal citizens, the knowledge that they must endure further delay is incredibly painful and frustrating. Prop 8 should never have been permitted on the ballot. The rights of a minority should never be put to a popular vote. Prop 8 was a toxic, anti-democratic measure that continues to wreak havoc in the lives of real people and families. The court should move as quickly as possible to resolve this issue. It is clear that California law does not give initiative proponents the power to override elected state officials who have decided not to appeal a federal court decision holding that a challenged state law is unconstitutional. The California Supreme Court should rule accordingly, and the Ninth Circuit should affirm Judge Walker's ruling. Prop 8 is blatantly unconstitutional, and it is past time for it to be gone.

Courage Campaign
“Today’s California Supreme Court ruling does not change the fact that a federal court has ruled Proposition 8 unconstitutional, but it does mean that thousands of loving LGBT families remain in legal limbo---unable to exercise their constitutional right to access the security and recognition that only comes with marriage. It is unfortunate that while many California families are able to marry at a time and place of their choosing, equally loving LGBT families must endure months and years of legal uncertainty. They have waited long enough. That is why we are asking the California Supreme Court to move expeditiously to resolve the standing question once and for all. And we are confident that no matter what their decision, Judge Walker’s ruling will ultimately be upheld and the days of second class citizenship for thousands of California families will be relegated to the dustbin of history.”

Geoff Kors To Leave Equality California

Equality California executive director Geoff Kors revealed today that he'll be leaving the organization this spring. EQCA spearheaded the unsuccessful attempt to defeat Proposition 8 in 2008. Seth Hemmelgarn at Bay Area Reporter:
Kors, who has been EQCA's only executive director since it was created in 1998, announced this morning (Friday, December 3) that he's resigning from the group, effective March 31. The date marks the eve of his ninth anniversary with the state's biggest LGBT rights organization. "I felt I'm ready to do some different things," Kors, 49, told the Bay Area Reporter , adding that nine years is a "long tenure" for the leader of a political organization like EQCA. He has yet to decide where he'll go next and has not applied yet for any other jobs.

Widely criticized for his leadership of the unsuccessful fight to defeat Prop 8 in the fall of 2008, Kors declined to talk about regrets or things he would've done differently. Instead, he talked about his accomplishments. He said when he became executive director, there was a staff of two, there was no statewide LGBT political action committee, and California was "a state with very limited rights" for same-sex couples. At the time, couples had less than 15 legal rights and protections, and there are now more than 400. He also pointed to employment and housing protections for transgender people

Noose Hung At Equality California

Workers arrived at the Santa Ana office of Equality California to find a small string noose hanging from the door. Local police were uninterested. EQCA employee Mel Distel relates her exchange with the cop who responded to her call:
"There was nothing they could do, of course, there was no suspect and no crime had been committed. The officer said 'what it is, is a string on a door.' My vision got blurry, I was embarrased and felt stupid for making the call. I took a deep breath and said 'Do you see any correlation between the fact that this is a gay office and there was a noose left on our door in the wake of all of these teen suicides?' The officer said, 'Sometimes you just have to live with being a victim,' and proceeded to mention that his car had been broken into before." That didn't exactly sit well with Distel. "As if that's the same. As if having your stereo stolen is anything like the message 'You should kill yourself.' As if random theft is anything like an act meant to convey hate and stir up fear in the heart of a minority group."
Making threats of violence against an LGBT group is considered a hate crime in California, despite the officer's indifference.

Quote Of The Day - Geoff Kors

"One of the things I sincerely hope Ken Mehlman has done or will do is to explain to George W. Bush how denying LGBT people equality causes real harm and how the GOP's anti-equality platform and campaigns lead to teen suicides and hate crimes. I hope he explains how bigotry impacted him and that he has asked George W Bush to join his wife Laura in supporting marriage equality. If he can convince Bush to publicly change his position that would be powerful.

"And I hope he shares with the public how the GOP used animus towards gay people to pass anti-marriage state constitutional amendments, as that will bolster the federal Prop 8 case. What he does to undo the damage he caused can be a part of his legacy and working with AFER to help overturn Prop 8 is a good start. We all have to hope he goes all out and proves he is a talented political strategist -- this time on the side of equality." - Equality California head Geoff Kors, speaking to reporter Rex Wockner.

HomoQuotable - B. Daniel Blatt

"In his latest email, the head of the gay affiliate of the California Democratic Party 'Equality California' tells us about 'the U.S. Constitution’s promise of equality for all'. Funny, I’ve read the U.S. Constitution more times than I can count and have never found. The framers did indicate that the charter’s purpose includes securing 'the Blessings of Liberty to ourselves and our Posterity'.

"Save for the Fourteenth Amendment when the word, 'equal,' appears, it only refers to legislative voting. And that Amendment specifies that 'No State shall make or enforce any law' which denies 'to any person within its jurisdiction.' Not sure how you get from that to a 'promise of equality.' Sorry, Geoff, you can’t read your ideological watchword into the constitution. It just ain’t there." - Gay Patriot blogger B. Daniel Blatt, hoping to be the next gay kapo quoted in court filings against marriage equality.

NEW STUDY: All That Money Spent On Prop 8 Advertising Was For Nothing

According to a new study just released, those zillions of dollars spent by both sides during the 2008 Prop 8 advertising battle didn't actually change anybody's mind.
The warring sides in the 2008 battle over same-sex marriage in California may have spent a combined $83 million for nothing, according to an academic study released Tuesday. The study by Patrick Egan of New York University looked at polling on gay marriage and domestic partner elections in 33 states since 1998 and found that no minds were changed despite millions in spending, hard-hitting advertising such as the much-quoted "like it or not" TV spot with San Francisco Mayor Gavin Newsom, and emotional pleas from both sides. By election day, voters who opposed same-sex marriage before the campaign still opposed it, and those who backed it continued to back it. "The study indicates that when all of this (campaigning) is over, the result is a wash," said Egan, who was joined by supporters of same-sex marriage at a news conference at San Francisco City Hall.
According to the above-linked story, the new study should serve as a warning to marriage proponents intent on putting the issue on the 2012 ballot. Equality California's Geoffrey Kors agrees that a majority support will be required before even considering the attempt: "We're not going in if the numbers don't make sense."
