Cliff Kincaid: Impeach Ruth Bader Ginsburg & "Known Lesbian" Elena Kagan

"Our media didn’t treat it as a big deal, but Justices Elena Kagan and Ruth Bader Ginsburg had both officiated at gay weddings. Groups such as the National Organization for Marriage, the American Family Association, the Coalition of African American Pastors, and the Foundation for Moral Law had called for Kagan and Ginsburg to withdraw from the case. Matthew Kidd, executive director of the Foundation for Moral Law, told Accuracy in Media that the failure by Kagan and Ginsburg to withdraw from the case leaves them open to impeachment and removal from the bench. In the case of Kagan, an Obama appointee, she may have had a personal conflict-of-interest. This is a sensitive matter, but various reports indicated that Kagan was a known lesbian before she was nominated to the Court by President Obama. For example, the gay blog QueerTY had identified her as a lesbian. That would mean she was compromised on homosexual issues prior to her ascension to the bench and after she was confirmed. This is a conflict of interest that cannot be tolerated." - Accuracy In Media head Cliff Kincaid, calling on Congress to impeach both justices.

A Clue From Notorious RBG?

Every word uttered by Supreme Court Justice Ruth Bader Ginsburg is being scrutinized for possible clues to the coming ruling on same-sex marriage and some are seeing another hint in a comment made this weekend during an interview with the American Constitution Society. Via the Washington Post:
Asked about the public’s rapid acceptance of gay rights, she repeated her view that it was a natural response to gay Americans being more open about their sexuality. “Gay people stood up and said, ‘This is who I am,’” Ginsburg said, and Americans saw that the person was a neighbor, a child’s best friend or maybe even their own children. They were “people we know and love and respect.” As she was speaking, the gay pride parade was rolling through downtown just a few blocks away, and the Capital Hilton, where the ACS was meeting, was flying a rainbow flag just below Old Glory. “The court is not a popularity contest, and it should never be influenced by today’s headlines,” Ginsburg said. But she added that it “inevitably it will be affected by the climate of the era. “I think that’s part of the explanation of why the gay rights movement has advanced to where it is today — the climate of the era.”

Concernstipated Women Have RBG Sadz

"No one can say with a straight face that Justice Ginsburg’s actions, as related to this case, have been anything but unwise and unethical. Chief Justice Roberts, who has defended the justices on the matter, wrote in one instance, 'I have complete confidence in the capability of my colleagues to determine when recusal is warranted.' He must be appalled by this particular situation. Justice Ginsburg’s shenanigans have done anything but instill confidence. The Supreme Court’s decision in June will be greatly diminished with her name on the opinion, no matter what the ultimate outcome is. Although Justice Ginsburg apparently feels a strong urge to express herself on this issue, her silence is the only thing that can actually advance her preferred cause. Will she be able to show the necessary self-restraint? History tells us it is not likely. Instead, the court should brace itself for further embarrassment. She seems to be pushing heavily for the Roe v. National Review Has Notorious RBG Sadz: She Totally Destroys The Rule Of Law

“The Notorious R.B.G.” is not the beneficiary of a grand expansion of imagination, a leap to a higher plane of Being. She is the result of an ideology of womanhood that has been militantly enforced on American politics and culture over the past half-century, not by latter-day Susan B. Anthonys but by knockoff Betty Friedans. Ruth Bader Ginsburg’s own service has been to impose that ideology on the law not from a seat in the legislature, but from her perch on the judges’ bench. By doing so, she has helped to legitimize the reduction of the Constitution and the entire judicial apparatus to an instrument for political gain, and to enshrine a vision of modern womanhood that cheerfully eviscerates any woman who believes otherwise. The Left thinks that is something to be celebrated?

NOM Has The Notorious RBG Sadz

In another display of judicial arrogance and bias, Supreme Court Justice Ruth Bader Ginsburg once again officiated at a same-sex ‘wedding’ over the weekend, this time perhaps hinting that the Court will find that such ‘marriages’ are required by the Constitution. The foundation of the United States judicial system is that the judge is to be unbiased in opinion, and should only consider the facts of a case. However, as “the groom and groom strolled down the aisle to the mellow strains of “Mr. Sandman,” Justice Ginsburg demonstrated that she holds a biased opinion with regards to same-sex marriage. While in the midst of a court decision that could change the fabric of America, it will be hard to trust a decision issued by a Justice who cannot refrain from publicly exemplifying their impartiality when it comes to the definition of marriage.
The above-linked post claims that this third wedding ceremony again emphasizes that Ginsburg should "remove herself from voting on the marriage case." That voting, not incidentally, has surely already happened.

RBG Emphasizes The Word "Constitution" As She Officiates Third Gay Wedding

Supreme Court Justice Ruth Bader Ginsburg coyly poked the haters this weekend as she officiated her third same-sex wedding. Via the New York Times:
Wearing her black robe with her signature white lace collar, Justice Ruth Bader Ginsburg presided over the marriage on Sunday afternoon of Michael Kahn, the longtime artistic director of the Shakespeare Theater Company in Washington, and Charles Mitchem, who works at an architecture firm in New York.

The gilded setting was elegant: Anderson House in the Embassy Row neighborhood, the headquarters in Washington of the Society of the Cincinnati, a club for the descendants of the French and American soldiers who fought in the Revolutionary War. During the ceremony, the couple slipped black and gold Harry Winston rings onto each other’s fingers.


But the most glittering moment for the crowd came during the ceremony. With a sly look and special emphasis on the word “Constitution,” Justice Ginsburg said that she was pronouncing the two men married by the powers vested in her by the Constitution of the United States. No one was sure if she was emphasizing her own beliefs or giving a hint to the outcome of the case the Supreme Court is considering whether to decide if same-sex marriage is constitutional. But the guests began applauding loudly, delighted either way.
I guess it's too late for the wingnuts to demand that she double-extra recuse. (Tipped by JMG reader Ed)

Foundation For Moral Law Files Recusal Demand Against Ginsburg And Kagan

Via press release:
The Foundation for Moral Law, a Montgomery-based nonprofit corporation dedicated to defending the Constitution as understood by its Framers, filed a motion Monday in the United States Supreme Court, urging the recusal of two Justices who have performed same-sex marriages. Canon 3A(6) of the Code of Conduct for United States Judges provides that “A judge should not make public comment on the merits of a matter pending or impending in any court.” 28 U.S.C. sec 455(a) mandates that a Justice “shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.” Because they have performed same-sex marriages, and because Justice Ginsburg has spoken publicly in favor of same-sex marriage, the Foundation contends that those Justices are predisposed to rule in favor of same-sex marriage and are unable or unwilling to consider this case impartially, and that their words and actions give the appearance of bias, if not bias itself. Foundation President Kayla Moore said, ” Common sense dictates that one who has performed same-sex marriages cannot objectively rule on their legality. If these Justices participate in this case, the Court’s decision will forever be questioned as being based on their personal feelings rather than on the Constitution itself. With far less evidence of bias Chief Justice Roy Moore voluntarily did not vote on the recent Alabama Supreme Court case regarding same-sex marriage. Justices Ginsburg and Kagan should follow his example.”

RELATED: Kayla Moore took over as head of the Foundation For Moral Law when her husband Roy Moore was reelected to the Alabama Supreme Court after having been booted from the bench for refusing to remove a Ten Commandments display from his courtroom. Roy Moore's triumphant return was bankrolled by a leader of an SPLC-certified racist hate group who recently "celebrated" the 150th anniversary of the assassination of Abraham Lincoln.

When she was a law professor at Rutgers and later Columbia, she became the leading (and very successful) litigator on behalf of women’s rights—the Thurgood Marshall of that cause, so to speak. President Carter appointed her to a seat on the U.S. Court of Appeals for the District of Columbia Circuit in 1980, and President Clinton to a seat on the Supreme Court in 1993. Having had the good fortune to serve beside her on both courts, I can attest that her opinions are always thoroughly considered, always carefully crafted and almost always correct (which is to say we sometimes disagree). The New York Daily News reports:
U.S. Supreme Court Justice Ruth Bader Ginsburg was hailed with rock star status Monday in Brooklyn Federal Court at a ceremony marking the 150th anniversary of the Eastern District of New York. Ginsburg was presented with a T-shirt — nearly as long as the diminutive justice — in keeping with the online cult fandom that has nicknamed her “Notorious RBG” for her stinging dissents. “You Want The Ruth? You Can't Handle The Ruth,” the T-shirt screams, playing off Jack Nicholson's famous line, “You can't handle the truth!” from “A Few Good Men.” Carol Amon, the chief judge for the Eastern District of New York, said the message was aimed at “cheeky male lawyers” who suggest that 82-year-old Ginsburg should step down from the Supreme Court bench.

NOM: Congress Must Investigate Ruth Bader Ginsburg If She Refuses To Recuse

We knew that Brian Brown wouldn't limit his outrage to this morning's two-line sound bite in World Net Daily. Just posted to NOM's website:
The National Organization for Marriage (NOM) today issued a demand that U.S. Supreme Court Justice Ruth Bader Ginsburg recuse herself from hearing the pending same-sex marriage cases because of comments she gave in a media interview that foreshadows her ruling in the upcoming cases even before they are briefed or argued. If she fails to recuse herself, NOM will ask Congress to conduct an investigation of her conduct and to consider legislation to discipline justices who speak out publicly about pending cases. "Justice Ginsburg has brought disrepute on the Supreme Court and eliminated any pretext that she will approach the marriage issue with an open mind when it comes before her. Because of this prejudice, federal law requires her to remove herself from hearing the cases," said Brian Brown, NOM's president. "If she does not step aside, we will ask Congress to investigate the matter and pursue legislative remedies."
Legislative remedies? Oh, my sides. The last time a Supreme Court justice was impeached was 210 years ago. And that removal attempt only succeeded in the House.

Ruth Bader Ginsburg: I Wasn't 100% Sober At The State Of The Union Address

Supreme Court Justice Ruth Bader Ginsburg's rabid Internet following is sure to go nuts over the admission that she dozed off at the President's State of the Union address after drinking a fine wine. Ginsburg was asked about her SOTU catnap Thursday at George Washington University, where she and her colleague Justice Antonin Scalia were interviewed by NPR. "The audience for the most part is awake because they're bobbing up and down all the time. And we sit there, stone faced, the sober judges," Ginsburg said. "But we're not, at least I was not, 100 percent sober." She explained that the justices have dinner together before the annual speech, which she said Scalia hadn't attended in several years, and that Justice Anthony Kennedy brought along a bottle of California wine that was just too good to resist.
