Eugene Delgaudio Vs Cory Brooker

Delgaudio is claiming that the misspelling was on purpose.
A Virginia-based group that opposes gay rights has sent out a postcard to New Jersey voters opposing U.S. Sen. Cory Booker’s re-election. But it spells the Democratic senator's name wrong. The postcard was sent out by Public Advocate of the United States, a non-profit group. On the front, it shows two men kissing and, in big white letters on a pink background, these words: “Is this Cory Brooker’s (sic) plan for New Jersey?” The president of the group, Eugene Delgaudio, said that was intentional.

“It’s a tactic to get attention, which we did get. You’re calling me,” he said of the ad campaign, which he said was “very low budget” and included about 50,000 postcards. His group is attacking candidates in other states as well. The back of the postcard says that Republican U.S. Senate candidate Jeff Bell filled out the group’s survey and “earned a 100% pro-family rating.” The postcard also incorrectly calls Bell, who has never won an elected office, a senator. It goes on to say that Booker did not answer the survey “and has earned a 0% Pro-Family rating due to his praise for homosexual ‘marriage’ and co-sponsoring the Gay Bill of Special Rights.”
Booker is leading Bell by double-digits. You should call Delgaudio and ask him for a souvenir copy of the above postcard. Also, here's a photo of ole Eugene and a giant cookie.

Eugene Delgaudio Has The SCOTUS Sadz

Eugene Delgaudio would like you to know that he made a recorded interview to with the media to express his outrage with the Supreme Court. Via press release:
Today with the announcement by the Supreme Court that they would not hear appeals to uphold traditional marriage we enter a new phase to preserve America's traditional values. We will not surrender the defense of marriage or the right to free speech for Christians and all those Americans who believe in traditional values. I promise you one liberal jurist, John Roberts, in a gown is not going to stop millions of determined traditional marriage believers in our right to proclaim traditional marriage and our moral values. Not without a fight. With this decision, the Supreme Court has stripped hundreds of millions of Americans of the Right to Vote their beliefs and protect their communities and families as they see fit. It is now Supreme Court precedence that Freedom of Speech and the Right to Vote are only recognized so long as they are approved by the Liberal Establishment.
Delgaudio goes on to vow to personally vet all future Senate candidates to make sure they will only support the nomination of an anti-gay Supreme Court justice.

VIRGINIA: Judge Tosses Out Recall Petition Against Eugene Delgaudio

The recall petition against Loudoun County Supervisor Eugene Delgaudio was tossed out today. Delgaudio, who is the only elected official who also heads an SPLC-certified hate group, has been accused of using public employees to work on his anti-gay campaigns.
[Judge Paul] Sheridan accepted the recommendation from Democratic Arlington Commonwealth's Attorney Theo Stamos, who was prosecuting the case on behalf of the commonwealth. Stamos, who was tapped to handle the matter following the recusal of Loudoun's commonwealth's attorney, reasoned Tuesday in a Leesburg courtroom there was not substantial evidence to take the recall effort to trial. The petitioners, known in court filings as the Citizens of Sterling, alleged Delgaudio used public employees and Loudoun tax dollars for political fundraising. Moreover, the Citizens of Sterling group claimed the supervisor's inflammatory rhetoric and fervent anti-gay views have caused dysfunction within Loudoun County government. Speaking on today's outcome, Charlie King, Delgaudio's attorney, said, “The two-year snipe hunt for Eugene Delgaudio is over. Before the bloggers chime in, everybody should know this case ended because there was no evidence.”
Last year a grand jury declined to indict Delgaugio for misusing public funds because Virginia only criminalizes such actions for full time employees. Being a county supervisor is considered a part time job. (Tipped by JMG reader Blair)

A Double-Dose Of FRC Lies

It hasn't exactly been a banner week for the Southern Poverty Law Center, which not only lost the support of the FBI but just yesterday, lost a federal court case as well. The defeat, combined with all the negative press over the government's growing wariness of the organization, is complicating matters for the once-prominent "civil rights" group. SPLC's most recent blow came at the hands of District Judge Wiley Daniel, who found no compelling evidence that the Public Advocate had acted improperly in using a photograph of two homosexuals in a mailing about candidates for state office. So ridiculous was the suit, Daniel found, that he dismissed it, insisting that it was well within Public Advocate's First Amendment rights to speak freely about same-sex "marriage."

"Public Advocate['s] actions are evidence that same-sex marriage can -- at the very least -- be considered as relating to political concerns of the community. Therefore," the court ruled, "I find that the mailers reasonably relate to a matter of public concern." For SPLC, which has been grasping at credibility since being linked in federal court to domestic terrorism, this was just another desperate attempt to cripple conservative organizations with expensive and frivolous legal suits that distract from their core mission. Fortunately for the Public Advocate, this latest victory only compounds SPLC's PR problems. If the group thought it was difficult to maintain government partners before, that task is becoming more complicated by the day.
LIE #1:  Jeremy Hooper pointed last week at Good As You that the FBI continues to list the Southern Poverty Law Center as one of its resources.

LIE #2: As I reported yesterday, the lawsuit against Eugene Delgaudio was only dismissed in part and the case will continue on its claims of copyright infringement.

Eugene Delgaudio Claims Partial Victory In SPLC Lawsuit Over Gay Marriage Photo

Back in 2012, Virginia-based anti-gay crackpot Eugene Delgaudio lifted the above wedding photo from the blog of a New Jersey gay couple, replaced the New York City skyline backdrop with snow-covered trees, and used the image for a flyer that attacked a pro-gay marriage candidate for the Colorado state Senate. After first sending an cease-and-desist order, in September of that year the Southern Poverty Law Center filed a federal copyright infringement lawsuit against Delgaudio.

This morning Delgaudio issued a triumphant press release which opens by declaring that he has won his motion to dismiss on one of the suit's two claims.
Yesterday, Monday, March 31, in Denver, Colorado, senior federal district judge Wiley Y. Daniel dismissed with prejudice one of two claims brought against Public Advocate by two homosexuals represented by lawyers from the leftist Southern Poverty Law Center ("SPLC"). SPLC lawyers had demanded a large money judgment for Public Advocate's use of a photograph of those two homosexuals in a mailing against pro-homosexual candidates for state office. The judge ruled for Public Advocate, finding that it had no commercial purpose in using the photograph, as it was involved in an important exercise of its First Amendment rights with respect to a controversial issue in the context of an election. The candidates opposed by Public Advocate were defeated in that election. The court ruled that "Public Advocate['s] actions are evidence that same-sex marriage can at the very least be considered as relating to political concerns of the community. Therefore, I find that the mailers reasonably relate to a matter of public concern."
While the judge did dismiss one portion of the suit, he ruled that the portion of the suit which claims copyright infringement may continue.
After careful consideration of the matters before this Court, it is ORDERED that Public Advocate’s Motion To Dismiss Plaintiffs’ First Amended Complaint [ECF No. 101] and NAGR, Rocky Mountain, O’Dell, Andrew Brown, and Dudley Brown’s Motion To Dismiss The First Amended Complaint [ECF No. 106] are GRANTED IN PART and DENIED IN PART. The motions are GRANTED to the extent that the First Amendment bars the Plaintiffs’ Colorado state law appropriation of name or likeness tort claim, and that claim is DISMISSED WITH PREJUDICE. The motions are DENIED to the extent that Public Advocate and the Defendants seek dismissal of the Plaintiffs’ copyright infringement claim based on the fair use doctrine.
The 18-page ruling is here. These things tend to make my eyes cross, so perhaps some legal eagles here on JMG can dig in and tell us what may happen next. Delguadio, of course, has issued a money beg to continue his defense.

Eugene Delgaudio Subpoeanas SPLC Over Their Hate Group Listing Criteria

Eugene Delgaudio has paid Christian Newswire to publish the below statement by his lawyer.
Almost every article written about Supervisor Delgaudio mentions the designation of Public Advocate as a hate group by the Southern Poverty Law Center. The Sterling petitioners (in a petition to remove Delgaudio from office) cited Public Advocate's hate group status as one basis for removing him from office. In today's America, calling somebody a member of a hate group is serious. I have filed a subpoena request for all documents the SPLC has about Public Advocate and Supervisor Delgaudio. The subpoena will be served later this week in Montgomery, Alabama. I've asked for information about the criteria, research and decision process used to designate Public Advocate a hate group. The quality of the SPLC's work goes to the weight to be accorded the hate group designation. Was the SPLC's decision to name Pubic Advocate a hate group made reluctantly, after careful study, or did some intern decide to send out a press release? This is an important question.
