CALIFORNIA: Hate Group Files Anti-Trans "Bathroom Bill" Ballot Measure Proposal

Privacy advocates have taken the first step to prohibiting unwanted intrusions in California bathrooms, showers and locker rooms. Privacy For All has submitted language to California elections officials to place the Personal Privacy Protection Act on the 2016 ballot. If approved by California voters, the Personal Privacy Protection Act requires that individuals "use facilities in accordance with their biological sex in all government buildings". The proposed initiative does not require private businesses to maintain sex separated facilities, but protects these businesses from legal action if they do require employees and patrons to "use facilities in accordance with their biological sex." "We have great compassion for any person that is uncomfortable in traditional, sex separated facilities. But we also want to protect the privacy that most of us expect when we are in public bathrooms, showers and dressing areas" said Gina Gleason, a proponent of the initiative.

PREVIOUSLY ON JMG: Last year Privacy For All failed in their attempt to force a public vote to repeal a California a law that protect transgender students, but they nearly succeeded in gathering enough petition signatures. Privacy For All leader Karen England has organized public school walkouts over the anti-bullying Day Of Silence. In 2009 England filed a failed federal lawsuit to overturn California's bill protecting LGBT students from bullying. In 2010 she tried to get then-California Lt. Governor Abel Maldonado to file an appeal of the overturn of Prop 8 while then-Gov. Schwarzenegger was out of the country. She then ran an unsuccessful campaign for Maldonado's job. In 2011 she launched a campaign to block transgender adults from changing their birth certificates. England was also one of the louder bigots against the repeal of DADT.

Young People Support Marriage Because Teachers Have Indoctrinated Them

"Unfortunately, I have to agree with George Will on this. The polls show and the stats show that older people are the number one supporters of traditional marriage, they are older people and they are literally dying. The people who are the biggest proponents of homosexual marriage, they’re young people, they’ve come out of our public schools, the teachers unions have been establishing this agenda and this indoctrination through our public schools for quite some time. So they’ve succeeded in this indoctrination process in many of our public schools across the country for a new way of thinking, a new perspective. Along with Hollywood, we have a whole new mindset and in fact young people are overwhelmingly, I think it is 2:1, in favor of legalization of homosexual marriage. Of course, that number could easily change to include other forms of marriage as society continues to slip down that slippery slope." - Brad Dacus, head of the anti-gay Pacific Justice Institute.

Another Lawsuit To Stop "Ex-Gay" Ban

"Of all the freedom-killing bills we have seen in our legislature the last several years, this is among the worst. This outrageous bill makes no exceptions for young victims of sexual abuse who are plagued with unwanted same-sex attraction, nor does it respect the consciences of mental health professionals who work in a church. We are filing suit to defend families, children, and religious freedom. This unprecedented bill is outrageously unconstitutional." - Brad Dacus, head of the anti-gay Pacific Justice Institute.  Dacus, who failed in his attempt to stop California's LGBT history bill, claims that 80% of "ex-gay" conversions are successful.  In 2010 Dacus also failed to force California to defend Prop 8 in court.

Wingnut Group Seeks Sanctions Against DOJ Attorneys Who Oppose DOMA

The anti-gay Pacific Justice Institute is calling for sanctions against Department of Justice attorneys who have refused to defend the federal government from lawsuits seeking to overturn DOMA.
“Government lawyers are essentially rising from the table for counsel for the defendant, walking across the courtroom and sitting down at the plaintiff’s table,” said PJI chief counsel Kevin Snider. “These attorneys are now seeking to have judgment taken against the party that they represent – the United States. Snider said what the DOJ has done would be “unthinkable for any other lawyers.” Their actions raise “serious concerns that professional rules and ethics are being violated,” he said. PJI plans to file complaints with various licensing agencies against the attorneys, whose names are listed online.
Pacific Justice Institute president Brad Dacus:
"When the United States and its agencies are sued over the Defense of Marriage Act, the clients are not the president or the attorney general – the clients are the people of the United States. It is bad enough for the Department of Justice to abandon its clients, but it is unethical and sanctionable for those attorneys to switch sides and ask for judgment leading to damages and attorneys’ fees against their own clients. We are calling on state bar authorities to simply undertake the same investigations and disciplinary actions they would take against any other lawyers who flagrantly violate their duties of client loyalty."

CALIFORNIA: Supreme Court Refuses Bid To Force Prop 8 Defense

The California Supreme Court has refused to force the state government to defend Proposition 8.
The state officials' decision not to argue in support of Proposition 8 has raised questions about whether anyone is legally qualified to defend it in court. The Pacific Justice Institute filed suit last week, arguing that the California Constitution requires Brown to defend the state's laws. A state appeals court dismissed the suit without a hearing, and the state's high court denied review Wednesday without comment. It will now be up to a federal appeals court, and possibly the U.S. Supreme Court, to decide whether Prop. 8's sponsors have legal standing - the right to represent the state's interests in defending one of its laws. Attorney Brad Dacus, president of the Pacific Justice Institute, said the court order was disappointing. "People on the left and right should both be mourning the fact that the attorney general and the governor are reneging on their oaths of office," Dacus said, arguing that the officials have a sworn duty to defend all state laws.

CA Supreme Court Asks Schwarzenegger & Brown About Prop 8 Defense Refusal

Karen Ocamb reports that the California Supreme Court has ordered Gov. Schwarzenegger and AG Jerry Brown to explain why they have refused to defend Proposition 8. The pair had until 9am today to respond. The Pacific Justice Institute was expected to rebut their response by noon today. Ocamb notes that "theoretically" the Court could order Schwarzenegger and Brown to defend Prop 8. More on this as it develops...

DENIED: Appeals Court Rejects Attempt To Force State Defense Of Prop 8

The California Court of Appeals has just denied the attempt to force Schwarzenegger and Brown to defend Proposition 8. "Petition summarily denied by order." The suit was brought by the anti-gay Pacific Justice Institute on behalf of Pastor Joshua Beckley, with a supportive brief from former U.S. Attorney General Edwin Meese. The court's full ruling should be posted here by the end of the day.

Anti-Gay Group Sues To Force Brown & Schwarzenegger To Defend Prop 8

Equality California issued an alert this afternoon that the anti-gay Pacific Justice Institute has filed a lawsuit in an attempt to force Gov. Schwarzenegger and AG Jerry Brown to defend Prop 8. And of course, the lawsuit is being brought on behalf of a Christian pastor.
The institute is arguing that as the state's chief law enforcement officer, Brown does not have discretion to defend only laws with which he personally agrees. And because the California Constitution gives the governor final say when he and the attorney general disagree on legal matters, Schwarzenegger must be compelled to file an appeal to preserve Proposition 8 as well, the group's lawsuit states. "To allow an elected official to trump the will of the people by mere inaction and the lack of fulfillment of their duty to do their job would be an egregious violation of public trust," Pacific Legal Institute Brad Dacus said Tuesday. The institute brought its motion on behalf of Joshua Beckley, pastor of Ecclesia Christian Fellowship church in San Bernardino, and included with it a declaration of support from former U.S. Attorney General Edwin Meese III.
Equality California's Geoff Kos: "This is an outrageous attempt to try and force elected officials who have sworn to uphold the United States Constitution to defend a law that the Federal Court has found to be unconstitutional. It demonstrates their acknowledgement that the proponents of Proposition 8 lack standing to appeal, that the case should be dismissed and loving same-sex couples should be allowed to exercise their constitutional right to marry."
