Federal Court To NOM: Get Lost

NOM has lost yet another attempt to evade Maine's campaign finance law after a federal appeals court refused to hear their case.

The appeal came after a 1st U.S. Circuit Court of Appeals in Boston a month ago rejected the National Organization for Marriage's challenge to Maine's political action committee laws, and upheld Maine's law requiring disclosure of independent expenditures in candidate elections. In a decision Wednesday, the court denied NOM's request for a rehearing. NOM was the primary donor in 2009 to Stand for Marriage Maine, a political action committee that helped repeal Maine's same-sex marriage law. Other legal issues between NOM and the state of Maine, including one dealing with disclosure of donors, remain unsettled.

HRC Issues Memo Detailing NOM's Many Donor Disclosure Court Losses

In what may be a shot across the bow regarding the upcoming marriage ballot in Maine, today the Human Rights Campaign issued a memo detailing NOM's unblemished record of court losses in their attempts to evade state campaign finance laws.

The latest in NOM’s string of legal defeats came on August 11 when the 1st Circuit Court of Appeals rejected the group’s challenges in Maine and Rhode Island. On its Law Blog, the Wall Street Journal put the cases into perspective. “The 1st Circuit issued rulings in two cases that raise an important campaign finance issue: the extent to which states can require advocacy groups to report details about their expenditures in support of candidates or political causes.” Given the recent historical record, states do in fact take disclosure, and legal compliance, in earnest. NOM has unsuccessfully challenged disclosure laws in Maine, Minnesota, New York, California, Rhode Island, and Iowa.

All of the above losses came after the fact, when the elections were already over, and NOM has flouted court rulings in every single case with no apparent punishment. What will be very interesting to see is whether NOM re-enters the Maine campaign having lost their disclosure case there. Oh, what a happy day it would be to see Slaggie and Brian Brown led away in handcuffs for contempt of court.

Liberty Counsel Publishes "Ex-Gay" Book About The Lisa Miller Kidnapping Case

Liberty Counsel attorney Rena Lindevaldsen has published a book about the Lisa Miller, the born-again "ex-gay" lesbian mom who kidnapped her own daughter rather than comply with multiple court orders to share custody with her former partner. The FBI has investigated the Liberty Counsel's role in the kidnapping as Miller and her daughter were found to be living in Central America in a house owned by the father of a Liberty Counsel employee. (That little detail probably isn't mentioned in the book.) Here's the blurb from Amazon:

NOM Loses Another Court Battle

The court-defying criminals at NOM have once again lost a battle to evade state campaign finance laws.

A federal appeals court panel Thursday rejected an anti-gay marriage group’s bid to block its need for compliance with Rhode Island campaign disclosure laws. The National Organization for Marriage had challenged Chief U.S. District Judge Mary M. Lisi’s refusal in October to grant a preliminary injunction that would have allowed the group to avoid disclosing money it spent to support various candidates, in accordance with state election laws. The group, which has launched similar lawsuits nationwide, had argued that Lisi erred when she denied the request. Judge Lisi concluded the disclosure law imposed little burden on the group and had a valuable governmental interest in identifying the people who give more than $100 to a support or defeat a candidate.

Don't expect NOM to bother complying with the above judgment.

NOM Continues To Defy Maine's Request For Campaign Donor Information

Maine is back in court again in their now years-long battle to get NOM to comply with state campaign finance law and release the names of their donors.

The National Organization for Marriage says that identifying donors would violate their First Amendment rights and deter future donors. Lawyers for each side presented arguments Wednesday in Kennebec County Superior Court to a judge who said she will provide a ruling in writing. Assistant Attorney General Phyllis Gardiner told the judge that the ethics commission wants to question donors. "What did they understand they were asked to contribute money for?" Gardiner said. The answers would help the commission determine whether the National Organization for Marriage should have registered with the state as a ballot question committee. State law says groups that raise or spend more than $5,000 to attempt to influence the outcome of any Maine election must register and disclose their donors.

NOM has offered the provide the amounts, but not the names of the donors. Why isn't Brian Brown in jail for contempt of court?

Democratic nominee Alex Sink is barely leading teabagger and scam artist Rick Scott in the polling for Florida governor. As the co-founder and CEO of Columbia/HCA, the nation's largest for-profit hospital chain, Scott was at the helm of the largest Medicare fraud case in American history, with his company eventually paying the largest federal fine of all time, $1.7B.

Scott is also the founder of the astroturf group, Conservatives For Patient Rights, which pretends to be a citizens group advocating for less government oversight of the health care industry. MAINE: Judge Orders NOM To Comply With Financial Disclosure Laws

It's too late to matter, but a judge in Maine has at last ruled that NOM must reveal where they got the money to fund their successful campaign to overturn same-sex marriage.

U.S. Magistrate Judge John Rich III said in a document dated Sunday that the National Organization for Marriage, which contributed $1.9 million to the campaign to repeal Maine's gay marriage law, should turn over fundraising documents dating back to Jan. 1, 2009, to the Maine Commission on Governmental Ethics and Election Practices. The ethics commission voted last October to examine the group's contributions after it was accused of not reporting the names of many donors.

NOM has consistently flouted campaign finance disclosure laws. There's no reason to assume that they'll comply with this latest order.

NY Senate Lays Groundwork To Expel Sen. Hiram "Slasher" Monserrate

Yesterday a New York Senate committee report indicated that the expulsion of Sen. Hiram Monserrate may finally be in the works.

Senator Hiram Monserrate behaved recklessly and callously after his companion was hurt during an argument at his Queens home, failing to call 911, dragging her violently through a hallway and taking her to a hospital miles away, according to a State Senate committee investigating Mr. Monserrate. A draft of the committee’s final report concludes that Mr. Monserrate seemed to be as concerned with keeping the confrontation last December from becoming public as he was with the safety and health of his companion, Karla Giraldo, according to a person familiar with the report. The report also found that Mr. Monserrate, a Democrat from Queens, refused to take full responsibility for injuring Ms. Giraldo, said the person, who asked not to be identified because the report is confidential. While it is not yet clear what sanctions the panel may recommend for a vote by the full Senate, the report’s harsh findings suggest that the committee is laying the groundwork for a stiff punishment for Mr. Monserrate, possibly even his expulsion.

Monserrate has refused to appear before the committee, probably sealing his fate. Stunning LGBT activists, last month the Queens Democrat voted against marriage equality, despite his previous promise of support. Adding assholery to injury, he later complained that just because he slashed his girlfriend's face, causing 40 stitches, he should be allow to see her: "Two adults who are consenting and who are like-minded and within their mental capacities should be allowed to be with each other. I think it's an outrage."
